死刑制度的存廢，數十年來在國際間爭論不斷，根據國際特赦組織 Amnesty International 統計，目前世界上已有88個國家廢除死刑，在台灣，學者也已從早先主張不宜冒然的廢止死刑，發展到目前通說認為宜逐步的廢止死刑，但民眾卻普遍傾向支持死刑的存續。由於死刑制度的存廢，關係著社會整體治安，在犯罪率居高不下的今天，死刑的嚇阻效果如何，仍有待進一步的探討。

本研究利用1973~2005的年資料，以複廻歸的分析方法，探討犯罪率與嚇阻變數、結構變數、社會變數、經濟變數間的關係，主要發現：

1. 警察的破獲率與犯罪率之間存在著顯著的負向關係，即破獲率對犯罪發生率有顯著的嚇阻效果。
2.執行死刑人數比率與暴力犯罪件數發生率有顯著的正關係，但與故意殺人發生率沒有顯著的關係，總體而言，死刑的執行人數比率是沒有嚇阻效果的。
3. 報案三聯單的新制與暴力犯罪件數發生率及故意殺人犯罪件數發生率間沒有顯著的關係。
4. 社會變項與暴力犯罪件數發生率及故意殺人犯罪件數發生率間，沒有顯著的影響。
5. 經濟成長率與暴力犯罪件數發生率及故意殺人犯罪件數發生率沒有顯著影響。但失業率與故意殺人犯罪件數發生率之間有顯著負向關係。

The usage of capital punishment system has been discussed for a couple decades. According to the statics of Amnesty International, 88 countries have abolished capital punishment. In Taiwan, many savants have changed their attitudes from not suddenly abolishing capital punishment to abolishing capital punishment step by step. However, most citizens tend to keep this punishment in Taiwan legal system. Capital punishment is one significant system to secure the entire society. Hence, the deterrent effect of capital punishment has to be reconsidered in the further stage.

This paper uses time series data 1973~2005 to analyze the relationship between crime rate, threat variables, structural variables, society variables, and economic variables. Several findings are as follows.

1. There is significantly negative relationship between clearance rate and threat variables, such as criminal occurring rate and murder rate per ten hundred thousand criminals.
2. There is significantly positive relationship between the rate of criminals executed and criminal rate. However, not enough evidence to show the relationship between executed rate and murder rate is found. In general, executed rate has no deterrent effect on criminal occurring rate.
3. New triplicate form of reporting case has no significant effect, neither do society variables.
4. No significant effect of economic growth is found. However, unemployed rate has significant effect on murder cases.
