本研究主要探討專利流氓在運用專利進行專利訴訟的攻擊時，所掌握的專利擁有何種競爭優勢。結合過去針對專利流氓定義的文獻，整理出關於專利流氓的資料庫，並以此進行判決書的蒐集，找出與專利流氓有關的相關侵權訴訟。針對文獻對於專利流氓擁有之專利的特性，運用價值專利的指標，探討專利流氓在進行專利訴訟時，有哪些指標是影響訴訟成敗的關鍵。
在研究中運用迴歸分析，發現專利流氓所擁有的專利在進行專利訴訟時，影響訴訟結果之關鍵在於專利佈局，也就是一個專利的專利家族，因此本研究便針對專利家族的定義：廣義及狹義的專利家族，進一步觀察何者為影響專利訴訟的原因，其結果發現無論在廣義及狹義的專利家族都影響著專利訴訟的結果，且呈現正向相關的影響，顯示著當專利家族愈多時，訴訟便有很高的機率取得勝訴。

This research aims to discuss what competitive advantages possessed by patent troll in offence of patent litigation. Through combining definition and constructing database of patent troll to collect patent decision and search relative infringement litigation. In addition, it focuses on patent characteristic of patent troll and valuable patent indicator to discuss what indicator would influence the litigation.
By using logistic regression model, this study finds that patent development (patent family) is the key point when patent troll in a litigation. In the further step, according to the definition of patent family, this study analyzes the effects of patent litigation. The result indicates whether general or narrow definition of patent family reveals positive correlation with patent litigation judgment, meaning that more patent family, more possible to recover.
