臺灣博碩士論文加值系統

自1989年我國正式開放外籍勞工進入國內市場以來，隨著臺灣產業結構改變、人口結構老化以及婦女意識抬頭促使婦女就業率提高，導致低成本勞力需求大量增加，導致產業外籍勞工的條件不斷放寬，且外籍家事勞工亦在1992年4月正式開放引進。目前有超過46萬名主要來自印尼、越南、菲律賓以及泰國的外籍勞工投入在我國的勞力市場，成為我國基礎勞動市場不可或缺的勞動力來源，然而這些外籍勞工的人權卻處於極弱勢的狀態，除了意識型態外在法規制度上亦遭受歧視性的待遇。
在全球化的影響下，外籍勞工的人權保障更顯得重要，國際勞工組織與聯合國亦不斷在這外籍勞工的人權保障上建構出越來越完整的體系，人權保障係一絕對性而非相對性的概念，不應該因國籍、種族或是身分有任何差異，本文即以此概念出發針對國際人權法上及我國法律規範上之外籍勞工人權保障進行探討。
在本文第三章中探討國際人權法上對外籍勞工人權保障上的規範以及沿革，諸如聯合國「所有移民勞工及其家庭成員權利保障公約」、國際勞工組織的「第97號為就業而移民公約」及「第143號移民勞工(補充條款)公約」。而在第四章中探討我國外籍勞工相關之法律規範，諸如在集體勞動權、個別勞動權、性別平等以及非法(非常規)外籍勞工人權上之規範，且對其沿革及衍生的問題進行探討，並藉由國際人權法上的規範對之加以檢視，最後提出修正上之建議。希望透過法律規範的修正，對在我國之外籍勞工的人權做出更周全的保障，創造我國經濟發展與外籍勞工人權保障上之雙贏。

Taiwan officially opens of introducing foreign workers since 1989, and because the changing of industrial structure, aging population and the employment rate of women increasing, the demand of low-cost labor substantial increasing as a result. There are more than 460,000 foreign workers that mainly from Indonesia, Vietnam, Philippines and Thailand, these workers becomes an indispensable part of our labor market. However, the human rights of these foreign workers in Taiwan, faces extremely serious problems of discrimination treatment, both in ideologically and legally.
Globalization creating a crowd of migrant workers, labors working across the borders more frequently, and the protection of the migrant workers becomes more and more important. The International Labour Organization (ILO) and the United Nations (UN) construct the migrant workers human rights protection system more and more completely. The protection of human rights is not a concept of relatively but absolutely, so the protection of human rights should not be any difference in nationality, race or status. This paper base on the following point, and uses the context of international human rights law to review on the protection of migrant workers’ human rights in Taiwan.
In the Chapter 3 of this paper, discussion on the specification and evolution of the protection of migrant worker’s human rights. Discussion and analysis the context such as United Nations’ 「International Convention on the Protection of the Rights of All Migrant Workers and Their Families」, and the ILO’s 「Migration for Employment Convention (Revised), No.97」、「Migrant Workers (Supplementary Provisions), No.143」. In the chapter 4, discussion and analysis the regulations and its evolution and, issues that relative to foreign workers in Taiwan, such as collective labor rights，individual labor rights, gender equality and the illegal (unconventional) foreign workers’ rights. Finally, review the relevant laws and regulations of the foreign workers by international human right’s law, and makes recommendations. Through the review and recommend expecting to construct a more completely protection to foreign workers in Taiwan, and create a win-win between Taiwan’s economic development and the human rights of foreign workers.
