For the Chinese society, the democratic constituional system is a conception from the Western, including the most important constitutional concept, the principle of separation of powers.Modern China from the late Qing Dynasty to the establishment of the Republic of China, has also experienced a series of constitutional movement and constitutional activities, including the late Qing constitution, "Provisional Constitution" promulgated, the five-power constitutional thought, and the "Republic of China Constitution" in 1947.In this historical period, China has experienced nearly half a century of constitutional exploration. This paper starts with the constitutional development of modern China in the late Qing Dynasty and the Republic of China, summarizes the relationship between democratic constitutionalism and Chinese society, and explores the most important principle of separation of powers in democratic constitutionalism, the process of emergence, evolution and perfection in this course of its development. At that time, the theory and practice of Chinese society existed, so as to provide some valuable reference and inspiration for the constitutional construction of China at present, through the collation and analysis of this significant history.
