摘要
現行國際海上貨物運輸法領域中,「海牙規則」、「海牙威士比規則」與「漢堡規則」為目前主要之國際公約。且自漢堡規則生效以降,海牙規則所欲達成國際海上貨物運輸法統一化之目的,正式宣告無法達成,且呈現一紊亂之局面。上述各公約乃係於不同之航運發展階段、代表不同利益之國家所締結,因此,對於運送人權利義務之相關規範亦當然存有相異之點。又加上對於國際公約與相對應國內法之解釋上,不同之法系與國家間亦存在著差異性。

聯合國大會於西元2008年12月11日通過UNCITRAL國際海上貨物運輸契約公約草案,並批准於西元2009年9月23日於荷蘭鹿特丹舉行簽字儀式,並將其稱為「鹿特丹規則」。鹿特丹規則之立法目的乃係欲統一現制底下三大公約體系於適用上之紊亂,尋求法體系之一致性,達成降低交易成本,並促進國海上貨物運輸之蓬勃發展。現今國際航運實務中,運送人權利義務扮演著舉足輕重之角色,於此,鹿特丹規則吸收三大國際公約與其他相關海上貨物運輸法之規定,立基於船、貨雙方利益之平衡點上,為一劃時代之嶄新規定。

隨著鹿特丹規則之誕生,可預見的乃係其關於運送人權利義務之規範,對於整體國際航運市場將產生深遠之影響。本論文即自國際海上貨物運送人責任規範之發展沿革為開展,並針對國際海上件貨運送公約之適用範圍加以闡述,隨後緊接著探究國際海上貨物運送人之責任,期中包括權利、義務與責任基礎,更一併針對國際海上貨物運送人之責任範圍進行整理與研究,並且輔以鹿特丹規則之最新內容,比較、歸納出與現制三大公約體系下之差異、利弊,進而得以體現當今國際航運實務之主流價值。

又肇因於我國於國際社會地位之特殊性,並無法參與鹿特丹規則之制定與簽訂,加上我國海商法最近一次實質修正距今已有13之久,許多規定是否仍然符合國際間之主流價值,容有疑義。是以,如何將鹿特丹規則之內國法化,於我國現制下更顯得重要,故本論文於最後自立法與司法二層面,探究我國對於國際公約實踐之態度,並以人權兩公約為例,分析未來欲將鹿特丹規則內國法化所可能採取之方式,並提出現行我國海商法增修方向之建議,希冀能與國際主流價值接軌,藉以達成促進我國航運業蓬勃發展之最終目的。
