偷渡問題是現代國家主權、國際社會開放和經濟全球化的副産品，它們是世界人口特別是勞動力國際性轉移的非法部分。

經過美國「911」恐怖攻擊事件發生後，又重新拾回國域之防護觀念且提高警覺，對於國際保全之防衛工作也就更加的嚴密。但在國際間發生的偷渡事件仍是層出不窮，各國相關管制單位更是防不勝防。

本研究以商船偷渡問題為主要研究對象，研究之範圍包括國際海事組織（IMO）有關海上保全之規範、海上人命安全國際公約與「國際船舶與港口設施保全章程」之相關規定，以及國內對於偷渡事件之相關法規之規定。此外，也針對國際與國內對於偷渡之定義、分類、方式與衍生問題加以剖析；並且列出國際間偷渡問題之相關統計資料、文件與現況並加以分析，同時亦針對國內面對大陸地區居民非法入境之問題加以收集並加以探討。

祈盼經由本研究以找出我國發生偷渡問題時處置方式之癥結點，及提供海運業對於商船上發生偷渡問題之防範與處理有所幫助，進而降低偷渡事件之發生率，確保國家社會及船舶營運的穩定。

In this era of national sovereignty, opened international society and global economy, stowaway problem has become a by-product. It influences the structure of world population, especially is the part of international illegal labor people.

After 911, the terrified attack incident happened in the U.S., every country restart to pay attention to protect concept and enhance alert for national territory. Therefore, each country works on protecting international security more strict. However, there are numerous stowaway incidents still happened among countries often. And it is very hard to guard against for the control department of each country.

This study focuses on ship’s stowaway problem. The study area including the security rules on sea from IMO, international convention about life security on sea, some interrelated rules of international ship and port facility security code and domestic law for stowaway incident. Besides, the study analyses the definition, classification, method and derivates problem of stowaway internationally and internally. And the study lists and analyses some statistic information, document and current situation on international stowaway problem. Meantime, the study also probe to Mainland China people enter Taiwan illegally.

I hope that we can find out the crux of handling stowaway and help to prevent and deal with ship stowaway problem by this study. Furthermore, the rate of stowaway can be reduced and national society and ship business can be guaranteed stability.
