臺灣博碩士論文加值系統

摘 要
　　「九一一」恐怖攻擊後，在美國要求下，「國際海事組織」通過「一九七四年海上人命安全國際公約」修正案，增訂附錄第十一之二章，採納「船舶及港口設施保全國際章程」，要求國際港口設施採取全球一致性之保全措施，評鑑弱點，以因應各項威脅。
　　本研究主要探討有關國際海事保全案例、聯合國及國際海事組織就海事保全議題之相關政策及法制規範、港口設施保全國際章程之相關法律與制度、國際港口設施保全行政管制措施與美、澳及我國對國際港口設施保全法制之實踐。
經由本研究，我國實踐國際港口設施保全法制改進建議如下：
一、制定法律或行政規則，據以執行。
二、建立保全共識。
三、明文管制外籍船舶進港之規範。
四、強化協調功能。
五、保全措施之具體化。
六、落實各項演訓。

Abstract
After the 911 terrorist attack, the International Maritime Organization（IMO）adopted a number of amendments to "the International Convention for the Safety of Life at Sea（the SOLAS）,1974" on 12 Dec., 2002 under the requirement of the US. With an addition of the Chapter XⅠ-2 of the amendment and its Resolution 2, adopting the International Code for the Security of Ships and Port Facilities（the ISPS Code）, it requested all the international port facilities should have the global security measures in agreement, and security assessments in accordance with the various terrorist threats.
　 The purpose of the research is to confer the international maritime security cases, the policies and legal systems of maritime security on the United Nations and IMO, the law and the related systems on international port facilities codes, the controlling measures of administration on the international port facilities security, and the practice on the international port facilities security of the tri-nation: the US, the Australia, and Taiwan.
Through this research, the suggestions of how to put the international port facilities security into practice for our state is as follows:
1. To enact and enforce the laws or administrative rules respectively.
2. To set up a common consensus of security.
3. To have the control of the foreign ships in and out the port proclaimed in writing.
4. To intensify the function of coordination.
5. To specify the security measures.
6. To carry out each item of drills and exercises.
