臺灣博碩士論文加值系統

人工生殖科技涉及醫學、社會、宗教、人口與兒童福利等各個不同面向，如何妥善的管制與管理，一直是世界各國急欲找出解答的問題。除了技術之外，對於相關執業人員以及機構設備的管制亦相當重要。本研究收集國內外相關的文獻資料，分別探討英國、美國與台灣的人工協助生殖技術現況與管制規範，對人工協助生殖技術與施術機構的管制作一個國際性的分析比較。
研究發現，英國一直在人工協助生殖科技扮演領航者的角色，無論是技術層面，甚至在管制上也率先於西元1990年立法責成管制機構來負責監督、核准人工協助生殖技術的實施與研究，並於1991年正式成立專責單位—人類生殖與胚胎管理局(Human Fertilisation and Embryology Authority)，其業務包括授與相關技術、研究的執照，以及出版全國的統計資料年報等，是目前對於人工協助生殖技術與機構管制最完備的國家。
相較於英國，美國則崇尚多元化的自由市場，隨著人工協助生殖技術的需求不斷上升，施術機構也逐年增加，而相關的管制與監督則採取看似較為開放的專業自制模式，主要由美國生殖醫學會(American Society for Reproductive Medicine)、人工協助生殖技術學會(Society for Assisted Reproductive Technology)提供執業倫理的執導綱領，並與疾病管制局(Centers for Disease Control and Prevention)及其他專業團體合作，進行施術機構的評鑑和彚整全國的施術資料出版年報；同時尚有許多其他各個層級的法令或規範將人工協助生殖技術納入管制範圍內，並不是完全的放任不管。
相形之下，台灣則由於「人工生殖法」草案的研擬過程延宕太久，且行政程序法的實施使得先前的「人工協助生殖技術管理辦法」失效，目前呈現無法可管的空窗期；而生殖醫學會以及衛生署國民健康局的協助監督、管制功能成效不彰，所提供的資訊過於簡陋，雖然同樣有發行施術資料年報，但時效與內容卻不及英、美兩國。
筆者建議政府可以考慮設置一個專責單位，尤其對於資料的彚整與通報應更加強，並提供給受術者、捐贈者和一般大眾更豐富的資訊，來改善國內目前規範與資訊都明顯缺乏的情況。

The field of assisted reproductive technology (ART) has witnessed spectacular scientific advances and additional medical applications. While developments in ART have evolved rapidly, so have the ethical, social and political controversies which surround nearly all aspects of ART. In order to avoid the adverse incidents happening, ART should be carefully regulated and overseen. This research gathered plenty of information and studied literature regarding the regulation of ART and of the premises to carry out in the United Kingdom, the United States of America and Taiwan respectively. A preliminary comparison of the three countries was conducted accordingly.
As a result of this study, there are different kinds of models to regulate ART and the clinics: the statutory authority regulation model and the professional self-regulation model. The front model, such as the Human Fertilisation and Embryology Authority in the UK, which was established in 1991 following the passing of the Human Fertilisation and Embryology Act 1990 to regulate and inspect all UK clinics providing IVF, donor insemination or the storage of eggs, sperm or embryos. The second model is through the guidelines developed by the professional societies to direct clinics, like the guidelines of the American Society for Reproductive Medicine and the Society for Assisted Reproductive Technology in the US. However, there are several mandatory regulations affecting ART by the federal government and other organizations, the current regulatory status of ART in the United States is far from laissez faire.
The situation in Taiwan is kind of in the middle, the legislation regarding the ART is incomplete now. Besides, the information provided from whether the professional societies or the government organization in Taiwan is short of, much less than it in the UK and the US.
In conclusion, ART is a complicated and rapidly changing clinical, scientific, and ethical field of human endeavor. Government has an obligation to provide adequate information and develop sufficient regulation promptly, especially to emphasize the data collection and report. Government can consider establishing a statutory authority to ensure higher quality care, protect the public interest, and create public confidence in ART services.
