美國著作權法制之發展，早在於建國初期即已發軔，一七九０年便已制訂第一部成文聯邦著作權法──「美國法典第十七冊著作權法（Title 17 U.S.C. Copyrights）」，惟因製造條款、登記制度等之堅持，其與國際著作權保護體系之規範多所扞格。一九八０年代，美國再重新調整腳步，積極參與國際著作權保護體系，以具體行動表達著作權保護之企圖心；一九八九年，成為國際著作權保護最重要之「伯恩公約」會員國，一九九四年修改著作權法以因應加入世界貿易組織WTO及與貿易有關之智慧財產權協定TRIPS。繼之更以一九九八年數位化千禧年著作權法案大幅增修著作權法，以落實世界智慧財產權組織WIPO一九九六年兩項國際著作權公約WCT、WPPT關於新科技應用與保護之規定，且繼歐盟之後，調整著作權保護期間為自然人終身加七十年，宣示美國保障其國人著作全球競爭力，以及面對數位化與網路時代之法制發展趨勢。
二十一世紀的今天，網際網路已經與日常生活密不可分，網際網路數位化環境著作權議題已經成為傳統著作權法制所面臨最大的變遷與挑戰。一九九八年數位化千禧年著作權法案雖然已經考慮到網路發展所帶來著作權侵害與保護問題，惟數位化科技之進步一日千里，不過三、五年時間，許多新興著作權爭議使得吾人不得不重新檢視現行美國著作權法在網路時代的適用是否足夠，是否能涵蓋多樣化數位科技著作權領域。網際網路上著作權侵權態樣十分龐雜且難加以預測，因為技術、規格、軟硬體不斷推陳出新，尤其關於重製、散布、下載、網路管理，以至於MP3數位音樂等之傳播，是否涉及侵權行為，是否有合理使用原則之適用，多媒體數位化著作在著作權法上保護標的之定位等議題，是目前相當受到矚目之焦點。
本文以美國著作權發展之歷史沿革為背景，探討美國著作權保護制度之演進，以及現今著作權法令制度與其內涵精神；進而討論二十一世紀網際網路時代，美國所面臨著作權保護之新挑戰。
在論文架構方面，第一章為緒論，敘明研究動機、目的、範圍與限制，說明章節架構。第二章針對著作權之一般概念，包含著作權意義、立法目的、規範對象等，以及著作權法制的一般原則，作概括性背景說明，並討論幾項國際著作權保護重要公約或組織，說明其價值與影響，尤其重視各公約與美國著作權法制之關聯。第三章針對美國法典第十七冊著作權法之立法精神、沿革背景、著作權主體、客體、侵害與救濟，以及著作權管理機關作深入研究，以時間為軌跡闡述探討過去美國著作權法制發展之哲學與基礎，其中歷程與變革，並針對現行美國著作權之法令內容與規範概要作概略之介紹。第四章探討美國當前所面對網際網路上之著作權議題，以網際網路上常見之著作權侵害與相關保護規定與法律適用為基礎，探討現行美國著作權法如何適用於數位化網路時代，重點則著重在網際網路上重製、散布等議題。第五章討論美國法院對於網路上MP3爭議最重要的三個判決，分別為Napster案、MP3.com案及Diamond案，依此界定未來網路上數位音樂在美國著作權法之適用問題與未來可能之發展方向。第六章為結論，綜合討論美國著作權法制之優點、缺失與發展趨勢，並且針對當前網際網路著作權爭議，與著作權法令之衝突與協調，作一綜合探討，並提出管理方式、修法方向等建議。
綜合言之，美國著作權保護制度之發展趨勢，傾向於和國際社會接軌，甚至超越現行國際著作權條約之基本規範，尤其國內立法之效率超越其他先進國家；其次，著作權保護期間延長、侵害著作權之民、刑事責任加重、隨時彈性修正以適應新環境、新科技之發展，為可見之立法趨勢；另外，對於登記制度，雖因國際條約之要求，已漸鬆綁，但仍有相當堅持。展望未來，著作權之保護與規範，首重網際網路著作權，以及數位化環境下之著作權新標的屬性界定，以及新型態侵權行為之防制與救濟；此外，一九九八年數位化千禧年著作權法案，已將著作權管理資訊以及禁止規避條款之適用，納入最新的著作權保護體系，而未來仍須針對合理使用之界定，以及網際網路相關業者、使用人之權利義務，作持續之檢討與規範，以因應不斷變遷之數位化時代。

The copyright protection system in the U.S. has long been built since its establishment, the first statutory law with respect to copyright protection, i.e., the publication of “ Title 17 U.S.C. Copyrights” in 1970. In previous American practice, certain restrictions and regulations of the copyright law, such as manufacturing clause, registration system and duration of copyright protection were inconsistent with the international conventions or treaties. Until the amendment proclaimed in 1988, the U.S. has then joined as a member of the “Berne convention” in 1989 -- the most important international copyright protection treaty in the world.
In the 21st century, the copyright protection problems on the “Internet” have become the greatest challenge among those posed under the traditional copyright rules and regulations. Although the Digital Millennium Copyright Act of 1998 has reformed some rules to deal with the impact causing from up-rising internet environment and high-tech, the progress of ever-changing digital devices in the modern world still comes with considerable uncertainties.
Starting from researching the history and background of the copyright law in the U.S., the author then follows on studying the regulations of the copyright law (on of basis of “Title 17 U.S.C. Copyrights of 1976” and other pertinent acts and amendments). This thesis has been centered upon internet copyright issues, particularly the problems in relation to illegal “copy”, “transmission”, “download”, “upload ” and internet management, including without limitation the new generation hardware and software. Further to explore the subject of digital data transmission, the thesis has discussed and analyzed several landmark cases, such as RIAA v. Napster, RIAA v. MP3.com and RIAA v. Diamond.
Finally, the author concludes with the discussions over the features, drawbacks, the trend of the copyright protection system, as well as making suggestions towards how to face the fast-changing digital age.
The context of this thesis contains the following six Chapters:
Chapter 1: Introduction, including the motive, objective, content, limitations and structure of this study.
Chapter 2: Concept of copyright and its international protection, including the definition, principle and ideology of copyright as well as major international treaties related to the U.S..
Chapter 3: Legal system of American copyright, focusing upon the spirit and history of general regulations thereof.
Chapter 4: Internet related copyright problems, discussing over the copyright issues on the Internet.
Chapter 5: Digital music (MP3) in practice, studying on several major cases regarding digital music transmission.
Chapter 6: Conclusion.
Generally speaking, the trend of copyright protection system in the U.S. is to conform with the international treaties; yet, in certain situation, it overrides the commonly accepted rules (for instance, duration of copyright has been extended to 70 years), cumulative penalty, criminal and civil, and continued amendment over the regulations to adapt to the transition. In prospect, it is extremely essential to face the challenges arising out of the digital environment and internet age, and to modify the copyright protection system in order to apply to the newly derivative forms of copyright infringement.
