臺灣博碩士論文加值系統

自1987年11月臺灣開放一般民眾前往中國探親，開啟兩岸(以下皆是簡稱臺灣與中國)經貿交流迄今已逾20年，並在2001年金馬小三通的實行及2008年兩岸簽訂之海峽兩岸海運協議後直航的開啟，打通了臺灣與中國間人民海上旅客運送的往來，並隨著臺灣與中國經濟之起飛，促進兩岸經貿的正常往來化並同時帶動了兩岸出國旅遊之旅客人數日益增加，讓利用海上船舶進行旅客運送之人數也日益擴增。相信隨全球經濟發展及兩岸政經推展，未來海上客運直航將會如同小三通一般大幅成長。
臺灣之海商法關於海上旅客運送章節共13條，且目前學術界對於海上旅客運送之相關研究分析明顯不足，因此對於海上旅客運送量逐漸成長，可能導致海上旅客運送之糾紛相對增加，因此本文首先進行探究臺灣與中國海上旅客運送人責任之問題，進而分析我國海上旅客運送法院實務案例，而後進行臺灣與中國間海上旅客運送人責任制度之比較分析。並針對實務契約及海上旅客運送人責任做為研究主軸，將兩岸直航客貨船中遠之星及海洋拉拉號之船票背面契約做一分析研究，並針對兩岸旅客運送之運送人責任制度予以探究，釐清兩岸旅客運送人責任之相關問題，並分析直航海上旅客運送契約上規定上之不足予以分析探究，期能對航運業界及立法上有所助益。
本研究發現臺灣在對於運送人責任期間及旅客人身及行李責任賠償限額之規定相較於中國之規定略顯不足，有必要加以增修相關之條款。而在實務契約分析方面，也發現契約內容中有部分條款之規定與臺灣及中國之法令有相牴觸之處，有修改之必要。

It has been over 20 years since the general public in Taiwan was allowed to go to China for visiting relatives and open the trade exchanges between Taiwan and China in November, 1987. After Three Links across the Taiwan Straits was put into practice and the two sides of the Taiwan Straits signed the Cross-strait Sea Transportation Assignment in 2008, the direct transportation opened the trade connections on passenger transportation between the two sides of the Taiwan Straits. Taiwan and China’s economic growth trigger the trade frequency between the two sides of the Taiwan Strait, the increase of the tourists and the improvement of the amount of people who use sea transportation. With the worldwide economic development and the political affairs and trade improvement between the two sides of the Taiwan Straits , in the future, the growth of the direct passenger transportation will increase as good as Three Links.
Maritime Law in Taiwan related to carriage of passengers by sea has 13 chapters in total and there is obvious deficiency of the related research analysis of carriage of passengers by sea in academic. Therefore, the gradual increase of the amount of carriage of passengers by sea may result in the increase of dispute relatively. Hence, this paper will explore the problem of the responsibility in carriage of passengers by sea between Taiwan and China firstly. Further it will analyze the legal cases of the carriage of passengers; then, it will analyze the comparison of the carrier’s liability between Taiwan and China. The legal cases and the carrier’s liability will be the main points, and the further research of the two-strait direct cargo-passenger ship—COSCO Star and Ocean LaLa’s ticket contract. And it will explore the system of the carrier’s liability and clarify the related problems of the carrier’s liability and the analysis of the deficiency of Passenger Transport Contract. The paper is expected to benefit the workplace and legalization.
The research found that compared to China’s rule, the rules in limit of indemnity of luggage and passengers’ selves and the period of responsibility of carrier’s liability in Taiwan are not enough. It must increase and mend related items. As to the analysis of contract, some of the items in the contract contradict Taiwan and China’s law. It has to mend as well.
