臺灣博碩士論文加值系統

營造業為國家和地區建設之重要基礎工業，直接影響國計民生，不但與國家和地區建設品質及經濟成長息息相關，亦影響其他產業之發展。然而如此重要的基礎工業，在台灣數十年來作為產業管理的法源依據僅為一行政命令位階的營造業管理規則，由於法律位元階過低，營造產業政策之執行無法有效落實，長久以來經營環境持續惡化，嚴重影響經濟建設。因此，行政主管機關要制定「營造業法」草案，亟欲完成立法程式以解決上述迫切問題，在歷經多年的立法過程及加入世界貿易組織的驅使下，營造業法終於在今年初(民國92年)經立法院三讀通過並於二月七日經總統公佈實施。營造業所依循的法令，終於從只有行政命令位階的「營造業管理規則」邁向真正法律位階的「營造業法」。
有鑒於營造業法實施後勢必對營造產業產生不小的衝擊，本研究旨以客觀務實的理念，從管理的觀點針對「營造業法」中較關鍵性問題進行分析，並藉由問卷調查的方法找出營造廠商對於營造業法中無法適應之事項，亦針對這些問題研擬因應對策。另外，本研究同時也擬定營造廠商經營策略方針，希冀能作為營造廠商提升經營體質之策略。研究成果期能作為營造廠商決策者的經營策略之參考，以符合產業界實際需求，進而健全營造產業的經營環境建設，以繁榮社會的經濟建設。

Abstract
The construction industry is pivotal to national construction. It directly influences national development and people’s lives. Not only is it closely related to national construction quality and economic growth, but also it affects the development of other industries. Important as it is, the law it was pursuant to in the last decade is merely the construction management rule, categorized in the executive order status. On account of its lowest status, prosecutions of the construction industry policy are unable to be carried out effectively. The environment has continuously deteriorated and seriously impinged on the national economic construction. For this reason, the executive intends to draft “construction law” to solve the impending problems as is stated above. However, behind the background of Taiwan''s WTO membership was approved,” construction law” finally havd beenlegislated in the January of 2003 and its contents bring an issue, especially its deficiency of management system. It will have a great impact on the development of construction industry.
From the viewpoints of management, this study will objectively concentrates on analyzing the fundamental problems of “construction law,” and broadly collect domestic and foreign data. By means of expert investigation method and questionnaire, opinions from different fields will be managed so as to work out a set of reasonable management strategies to perfect “construction law.” When the administrative authorities revise the construction law, they can make reference to this study in hope of meeting the needs of the industry field, bettering the construction environment, and making the national economic construction prosper.
