臺灣博碩士論文加值系統

雖然法規對違章建築認定已有明白規定，但仍因外在因素，造成執行困擾。本文發現施工中違建的查報認定常因民眾消極不配合或民意代表介入，造成原應即時強制拆除之標的，最後形成常態性違建。本研究期望透過台北市違建查報業務主管之深度訪談與查報員之問卷分析，瞭解在執行是否有窒礙難行之處，並提出短中長期因應對策，作為政府主管機關執行違章建築查處業務之參考。本研究成果如下。
一、查報人員對違章建築查報之業務內容及法條認定是相當熟習。惟值得觀察的是查報人員對實務執行是否可依規章程序確實執行，及外在因素造成執行成果與民眾期待產生落差，造成民眾誤解而增加政風單位的關切是感到憂心。
二、目前「施工中違建」的認定方式雖已有標準作業流程，惟經問卷調查結果顯示並非易於執行作業，凸顯出其外在因素影響執行成效，需主管機關提出因應對策。
三、訪談者均建議中央應修正建築法規，針對「違建」應以罰代拆方式讓被拆除的代價遠高於使用違建利益，並要求使用人、建物或土地所有權人負起自行拆除責任，否則處以罰鍰，並得連續處罰，應可有效遏止新違建。

Although the regulations on illegal construction to determine that there are clear provisions, but still because of external factors, resulting in implementation problems. This article found that the construction of the violation of the search reported that often because of the negative people do not cooperate or representatives of the public to intervene, resulting in the original should be forced demolition of the breach, and finally form a normal violation of the building. It is hoped that through the in-depth interview and the questionnaire analysis of the interviewers in the Taipei City, we can find out whether there is any difficulty in the implementation, and put forward the short and medium-term countermeasures, as a reference for the government authorities to execute the illegal construction and investigation business.The results of this study are as follows.
1. The investigation officer is quite familiar with the business content and law of the illegal construction inspection. What is worth observing is that the investigators are concerned that the implementation of the practice can be carried out in accordance with the regulatory procedures, and that external factors result in a gap between the results of implementation and the expectations of the population, resulting in a misunderstanding by the public and increasing the number of government wind units.
2. At present, although the method of identification of "construction breach" has standard working procedure, the questionnaire results show that it is not easy to carry out the homework, and it is obvious that the external factors influence the implementation results, and the competent authorities should put forward countermeasures.
3. The interviewers suggested that the central government should amend the building code, and that the cost of demolition should be much higher than the use of illegal construction in order to "construct in breach". and requires the user, the building or the owner of the land to take responsibility for their own demolition, or the penalty fines, and the continuous punishment, should be able to effectively curb the new violation.
