司法院大法官於九十年十二月十四日，就警察臨檢勤務，作成釋字第五三五號解釋。該解釋文出爐後，對社會大眾及警察人員皆造成了相當大的衝擊：電視新聞中，不時看到某些民眾拒絕警察臨檢的畫面，因為這些民眾誤以為警察從此以後將不再具有臨檢的權力﹔另一方面，解釋文亦引發部份警察人員消極不作為的反應（侯友宜，民91，頁25）。這些現象對社會治安造成負面影響，應不是大法官的原意。未來，是這樣的負面影響將持續發酵，還是，大法官兼顧個人人權與社會秩序的本意會逐步實現？
本研究將從政治發展的觀點，審視我國過去以來，大法官解釋對警察政策的型塑作用﹔其次，本研究將探討警察組織對此次大法官的解釋所採取的因應作為﹔復次，本研究將從各種角度評估釋字五三五號對我國警察政策所造成的實際影響。
本論文共分為七章，計十萬餘字。
第一章：說明研究背景，動機目的、方法流程、限制範圍及名詞解釋。
第二章：我國警察司法環境變遷之文獻探討，從外在環境系統理論描述對警察政策之影響，以違憲審查案件的作用與方向，瞭解司法解釋已朝人權方向遞移，再從歷屆大法官對警察主管法律之解釋，釋字第一六六、二五一、三八四、四四五、五二三號等大法官解釋文，得和司法解釋對警察政策之影響。
第三章：警察機關對歷屆大法官解釋的回應，從一０五至五二三號的回應、警職法制定與落實五三五號解釋、並描述我國執行臨檢勤務概況。
第四章：績效統計圖表分析呈現趨勢，深入瞭解變項並檢查變項是否出現異常分布的現象。
第五章：員警深度訪談與民眾電話訪問，以台北市政府警察局員警實施問卷調查並對全國民眾實施電話訪問，以瞭解員警及民眾對司法院大法官第五三五號解釋文的看法。
第六章：發現與討論，從文獻探討、員警訪談、問卷及電訪中，加以討論員警的勤務作為是否已符合釋字第五三五號解釋意旨。
第七章：結論與建議，提出本文研究的結論與建議。
