自數位科技發展以來,音樂產業的著作權管理備受挑戰,由於音樂的利用形式多元,著作權其版權資訊與授權管理一向是有待整頓的問題,分散的版權資料庫、各方資訊不同步與繁瑣的交易過程,徒增利用人在授權申請的負擔;而網際網路的普及,與低廉的複製成本,更使得侵權的情況不斷發生,權利人之權益屢遭漠視,侵權問題長期無法獲得改善,進而連帶影響整體音樂產業之收益。
而區塊鏈問世之後,讓著作權管理出現新的契機,其新型態的網路自主運作機制,利用分散式的網路儲存模式,可以解決版權資料分散的問題,而區塊鏈結合智能合約,更可以簡化授權交易流程,使得音樂著作物的流通與利用變得容易;此外,區塊鏈結合加密演算與數位指紋等技術,可以替每份數位音樂的副本建立識別性,藉此進行侵權的管理。
本研究針對目前音樂產業之著作權管理所面臨的主要問題,試圖探討新創公司如何透過區塊鏈技術提供解決方案,而針對公開演出管理問題,本研究提出CheckPoint公開演出管理平台方案;再從內部系統面、外部環境面兩個面向做環境評估,分析區塊鏈技術應用於著作權管理及其意涵、現階段可能會面臨的隱憂,以及中介團體如何因應市場變化調整其功能。期望藉由現有技術與資源整合,依據音樂著作權之權能屬性的不同,滿足不同的授權利用的需求,建構出除了企業或組織之外,例如consumer to consumer(C2C)的授權管理平台,以擴大音樂著作物的利用率,也保障音樂著作權人之權益。
Copyright management in music industry has encountered difficulties since the digital revolution. Due to the numerous forms of music utilization, the management of copyright information and authorization have always been subject to adjustment. Unsynchronized copyright data and complicated licensing process have increased the cost of music authorization. Also, the popularization of the Internet and the low cost of music replication make infringement become more serious. The rights and interests of the right holder have been ignored repeatedly, and the problem of infringement has not been improved for a long time, thus affecting the profits of the whole music industry.
The blockchain gives new possibilities to copyright management. The problem of distribution of copyright data can be solved by using the autonomous operation mechanism with its decentralized storage structure. The combination of blockchain and smart contract can simplify the licensing process and make the utilization of music easier. In addition, blockchain combined with encryption algorithm and digital fingerprint, which can establish identification for each digital copy, so as to conduct the management of infringement.
This paper focuses on current major issues of copyright management, trying to explore how new companies provide solutions with blockchain technology. Regarding public performance management problem, this paper proposes the CheckPoint public performance management platform. The implementations and implications of management are summarized in this paper, through analysis on both internal blockchain system and external environment side. In the meanwhile, the difficulties that may be faced at this stage, how intermediaries can adjust their service in response to the changing market, are also included in the discussion.
Hopefully through the integration of technologies and resources, according to different types of music copyright, a licensing platform, not only for enterprise or organization, but also for consumer to consumer (C2C) use, can be constructed to expand the utilization rate of music, and the right of music copyright holders can be well protected.
