本論文係以中國大陸現行工會法,就其相關法律體系,依一般行政法原理
,整理研析。研究目的,是使在大陸地區投資經營之台商,熟稔大陸工會
法制及工會具體作用,以資建立經營管理制度、締造協調穩定勞資關係之
因應。本研究結果如下:一、企業宜由互助角度定位工會係必然存在之利
害關係互助體之社團。二、企業應由法源角度與意義中,掌握具體規定及
政策變動,並及工會與中共之恆常關係。三、企業宜強調企業自主權之實
現,並以經濟性之管理制度,加強工會在科技文化教育之任務。四、企業
宜對工會依法處理,強化協商功能,防止其行政官僚化;且組織企業主團
體,發揮作用。五、企業應培養利益均霑之合夥關係;建立談判制度,確
立工會權義條款於責任化之團體協約中。

The present thesis is to arrange,study and analyze current Law
of Union of Mainland China based upon related system of law in
accordance with the principle of general administrative laws.
The object is to facilitate the businessmen coming from Taiwan
to invest、operate business in Mainland China to acquaint with
the system of the law and concrete function of union in order
to establish appropriate system of management and admistration;
co- operative,stable relationship between labour and capital.
The achievements of the present study are as follows: First,
the enterprise should set the position of the union from the
angle of mutual assistance as it is a mutual assistance social
group providing proper common interests. Second, the enterprise
had better grasp concrete stipulations ;the variation of policy
from the angle and meaning of the source of law as well as the
constant relationship between the union and Chinese Communist
Party. Third, the enterprise should stress the realization of
its self decision-making power;reinforce the mission in science
and cultural education of the union with the system of
management of economic orientation. Fourth, the enterprise has
to deal with the union by laws; reinforce the function of
consultation,and do prevent its bureau- cratization in
administration.On the other hand, the group of business
executives had better be orginized and put into fully play.
Fifth, the enterprise should cultivate partiner relationship
and build negotiation system with the union to share profits;
to establish the provisions of the rights and obligation of
union in the dutiful group agreement.
