政策貴在能行,否則只是紙上談兵,而貽有「空中樓閣」之譏。本研究係以保林政策執行所面對的各層面問題為分析焦點,經由理論建構、實務探討、實地訪談及問卷調查等方法檢視本省保林政策執行之問題並予解決,以為林業管理機關之參考。
研究結果提出下列七項建議:
一、強化法規整理的機動性
(一)林業管理機關應設立法規整理小組,適時合理修訂保林相關法
規,以應付業務急劇改變之需要。
(二)鑑於國有林係由臺灣省政府代管之事實,森林法宜增列省主管機
關行政罰鍰權,方為允當。
(三)為落實森林法第一條之旨趣,森林法罰則章中,宜增列珍貴稀有
植物加重罰則條款。
二、妥適提供合理保林政策執行資源
(一)編訂「保林配備標準表」,就各項保林設備之多寡及使用年限,
明確的依各林管處之不同而予以規定,以因應保林之需要。
(二)護管人員之甄選宜由工作站直接辦理,期使護管人員能適得其
所。
(三)應建立一套森林護管資訊系統,以避免護管人員因異動而造成資
料的流失,並協助災害的防救事宜。
三、加強機關組織間的整合與協調效果
(一)國有林宜收歸中央直營,以便林務局能有餘力專注於省內林政業
務。
(二)為利於自然生態保育工作的進行,宜建立整體性之自然資源保育
法規,以整合森林法、國家公園法、野生動物保育法及文化資產
保存法等法令。
(三)為利於林政與警察機關間平時連繫事項推行,宜依照森林法第八
條規定,提供必要及所需用地給予警察機關興建廳舍。
四、強化執行機關組織結構功能
(一)林業管理機關宜分別設立計畫規劃及公共事務等兩個統合部門,
以統籌各該機關之計畫及宣傳業務。
(二)林業管理機關宜增列森林火災保險及辦理救火人員投保與危險加
給等業務,使森林資源及救火人員之生命得到保障。
五、重視經濟社會與政治環境的影響
(一)保林政策之執行,應考慮與外界環境之配合,以增進政策執行之
穩定性。
(二)林業管理機關宜安排課長級職位以上人員參加村里民大會,主動
宣導政令,以建立林業人員走入社會的模式,讓全民參與保護國
家森林資源。
六、提昇執行人員的意向與工作態度
(一)為提昇保林政策執行人員的工作投入與組織認同,林業管理機關
應儘量滿足執行人員生理、安全、歸屬、尊重、自我實現之需
求。
(二)林業管理機關對於「士」之角色應予以釐清,期使技術士能全心
投入巡視工作。
七、健全績效考核指標
(一)團體績效考核宜以公開為原則,以消除猜疑心理。
(二)個人考績宜制定一明確之衡量尺度,以臻公平。
A valuable promulgated policy should be with excellent executive efficiency,otherwise it is just another unworkable theory put in writing. In this research,we analyzed some different kinds of problem according individual aspets when people dealing with execution of forest protection policy. Furthermore,we tried understand the problems caused from the execution of forest protection policy through doing the research on academical theory, the discussion under practical circumstances, interview with peoples and questionnaire ....etc.and tried to figure out the best way for the problems. Here we proposed the result forward to the forestry authorities. According the result,we made following seven suggestion for coping with this problem:
Ⅰ. Intensify the feasibility for manageing the regulation.
1. Establish a group specifics in the management of
regulation. This group just provide the need for
rectifying the regulation following the impatient need
of changing condition.
2. According to the fact that the National Forests is under
the management of provincial administration, we
suggested the penalty for authorizing institute should
be added to the Forest Law.
3. To carry out the first article in the Forest Law,
increase the penalty when people destroy some
precious and rare species of plants is suggested.
Ⅱ. Properly provide the reasonable source for the execution
of theforest protection.
1. Indentify the amount and useful time limit of the
required equipment, then indicate the 〝Forest
Protection Equipment Inventory〞 by forest district
office.
2. The selection of the patrol should be authorized by the
working stationthen we can make sure the chosen one
would be the most fitted one.
3. Set up the 〝Forest Crusing Information System〞,
Therefore this will guarantee that we won''t miss any
information. Because when people left their position,
meanwhile they would be helpful for the prevention and
release of calamity.
Ⅲ. Intensify the efficiency of collaboration and coordination
between varieties institutes.
1. The National Forests should back to be in charge
directly under the Central Government, the Taiwan
Forestry Bureau could focus their energy on the forest
administration and policy in their own province.
2. For the processing of the natural ecology
preservation work, we suggest to promulgate the
regulation for the natural resource conservation.Then we
believe this could be helpful for the coordination
between Forest Law, National Park Law, Wildlife
Preservation Law and Cultural Heritage Law.
3. Provide the policy department a specified location
building by following the Forest Law eighth article:
A specified location should be built for the
convenience to contact with the forest
administration and police office.
Ⅳ. Intensify the function of the executive institutes.
1. The forestry authorities should establish the project
regulated and public affair two branches which
responsible for collaborating projectsand propagation.
2. The insurance for the fire-fighter and the benefit for
this job should be considered by the forestry
authorities.
Ⅴ. Emphasis the influence between the Economics and Political
circumstances.
1. The execution of the policy should match its surrounding
circumstances, then this could help the stability for
the policy execution.
2. Put the propagation of the regulation into the
community routine meeting to help people get involved
with the protection of national forests and resource. Ⅵ. Promote the participation and enthusiasm between workers
one another.
1. The forestry authorities should satisfy the need of
physiological,safety, love, esteem, self-actualization
for each workers. therefore it can promote the
motivation of workers in their job.
2. The forestry authorities should pay more respect to the
technician which can promote them to be more enthusiasm
on their job.
Ⅶ. Establish sound precursor for the examination of
performance.
1. Put the examination of the performance of each
worker in publicway to convenience to belief of
people.
2. The personal examination of the job''s performance must
be valued under one unique and fair standard.
