  近來,國際間兩性平等思潮的沸騰,產業結構的升級及勞動力之大量需求,女性勞工愈顯重要,女性勞動力的開發更是當務之爭。因此,促進女性就業的措施,已成為當前各國政府勞動政策極重要之一環。
  日本對於保障女性就業權利之起步較歐美各國晚,但自1980年代中期以後急起直追,相斷制定影響女性就業權利至深的「男女雇用機會均等法」及「育兒、看護休業法」。雖然目前日本正處於高失業率的困境,但預計在西元2000年後,日本將會因為晚婚及生育率下降等問題呈現勞動力不足的現象,故應未雨綢繆積極開發與活用潛在的女性勞動力。而臺灣女性勞參率較日本或其他先進國家低,卻也顯示臺灣女性勞動力開發潛能極大。
  探究女性在就業上最大的障礙即為工作權利的不平等(就業上性別歧視)與育兒、家人看護等家庭貴任之牽絆,日本政府如何從法令政策上為女性解除這些障礙、此類制度措施實施後在效果如何、有何應改善之處及其改善方向為何、這些課題均為尚在起步階段的臺灣所應引為殷鑑。
  本論文首先比較日本與臺灣女性就業之現況與阻礙,其後分就日本「男女雇用機會均等法」及「育兒、看護休業法」的立法背景、內容及施行效果加以探討,繼而研究並檢討臺灣之相關立法與措施,以供我國政府未來擬訂相關的政策之參考。
  Recetly, there are more nations pay more attention on the equal right between men andwomen. Because of the industrial promotion and lack of working labor, female labor becomes a highly valued human resource that has not yet to be fully developed. therefore, the development and utilization of female labor force has became one of top agenda in manpower police in each country.
  The beginning of protecting female employment''s right in Japan is latter than the countries in Europe and America. However, after the middle of 80s, Japan catches up in haste. 「Equal Opportunity Act」and 「Child, Family Care Leave Act」are drew up one after another. Although nowadays the high rate of unemployment in Japan is in a difficult situation. After 2000AD, working labor will represent sufficient phenomenon cause the problems of get married late, the reducing rate of birth and etc ……Thus, potential female labor force should develop positively and use well. The rate of female labor participating in Taiwan is lower that Japan or the other developed countries. Meanwhile, it shows the great potentiality of developing Taiwan''s female labor participation.
  Studying the greatest block on female employment lies in the unequality of working right (Gender discrimination on employment ), Child-raising, family care and etc… How can Japanese government remove these blocks for women throughout policy? What ''s the effect after the laws enforcing Taiwan should take these subjects as lessons.
  In the first place, the research compares the situation and blocks of female employment both in Taiwan and Japan. Then, legislative background, contents and effect of 「Equal Opportunity Act」and 「Child, Family Care Leave Act」are concerned . Finally, studying the discussing Taiwan''s relative policy.These subjects can provide reference about relative policy for our government.
