國際核能法乃為當代國際法一新興領域，本文即為了解國際核能領域攸關核能安全，放射性廢棄物以及越境損害所引起之國際責任問題，本文乃採文獻分析法、個案研究法及歷史研究法等為研究工具，從歷史事件、國際機構、國際條約、國際習慣、國家實踐與國際法院訴訟案及諮詢案等資料進行分析，觀察國際核能法在核子安全、核子物質及放射性廢料之管理與運送、核子武器乃至於核子越境損害引發之國家與民事責任等領域內之發展與條約適用之情況，故本論文研究重心在於透過當代國際社會對於核子問題之規範，了解國際核能法實質內容及我國在核能方面之相關規定，進而積極負起國際法上之義務。
在章節的結構安排上，本論文第二章先就國際核能法之源起、發展趨勢及未來影響加以觀察，近代國際上所發生過的重大核能電廠事故，實為國際組織及各國急欲建立一套完備之國際規範的導火線，特別是在美國三哩島核電廠及蘇聯車諾比核電廠事故之後，因為人為的疏失而釀成重大災變，使得國際原子能總署（International Atomic Energy Agency, IAEA）主導通過一連串有關核子安全之多邊條約，特別受到矚目，國際組織對國際核能法發展之貢獻更不在話下，國際原子能總署、歐洲原子能共同體、經濟合作暨發展組織核能署以及國際勞工組織等國際組織通過之多邊條約，亦是世界各國所遵循的規範，自美國前總統艾森豪（Dwight D. Eisenhower）於1953年在聯合國大會發表「和平使用原子能」（Atoms for Peace）演說後，對和平使用核能的倡議與發展就更加重視，同時因核能事故所引發的越境污染損害責任問題，也是國際核能法發展的重要範疇之一。
在了解國際核能法發展之背景後，本論文將分成兩大範疇來探討國際核能法之實質內容，首先於第三章討論有關核子物質及放射性廢棄物處置跨國運送之國際法規範，以國際合作的形式來面對核子物質的保護，低放射性廢料跨國境運送及管理已使用過的核燃料等，至今均有長足之發展與成果，另輔以我國原子能相關法規為例，窺探我國在處置跨國運送規定與國際規範之異同；其次於第四章則對核子越境損害責任國際規範之範疇，導入「無過失責任原則」，採取污染者負擔，探討核子越境損害引發國家責任與民事責任問題，其他如保險、有限責任、非締約國之索償並兼論其對環境污染之影響。
