摘 要
近年來，犯罪暴力化及惡質化幾乎成爲主流趨勢。而其中，性侵害殺人案件由於兼有性侵害及殺人之犯罪特質，對於女性等弱勢族群的人身安全更造成嚴重的威脅，隨之引發的社會震撼亦極爲深遠。

本論文爲瞭解本土性侵害殺人案件之特性，俾利提供偵査及後續研究參考，篩選及蒐集台灣地區最近十年內性侵害殺人案件共四十二件進行質化及量化研究。在量化方面主要以內容分析法針對資料進行分析，再以敘述統計分析及關聯性分析等統計方式詮釋產生數據。在質化分析方面主要針對十二個性侵害殺人犯罪人進行心理測驗分析及深層訪談，以解釋犯罪人之犯罪心理及行爲特性。本研究結果發現：

一、性侵害殺人犯罪人、被害人、犯罪情境、犯案手法及犯罪現場特徵皆有其特異及關聯之處，犯罪預防體系可針對犯罪高危險群及犯罪情境進行預防，偵査人員也可針對現場特徵及犯案手法推測可能之犯罪者。

二、性侵害殺人與殺人案件及性侵害案件，在發生場所、犯罪工具、犯罪人職業、年齡及被害人諸項特性皆呈現顯著差異結果。同時，在發生時間、犯罪工具及被害人的諸項特性與殺人犯罪較類似，在發生場所及犯罪人的諸項特性則較與性侵害犯罪較類似。

三、在三組連續性侵害殺人案件中，同一犯罪人犯下不同案件之各項特性總平均相似度高達78.57%，顯示連續性侵害殺人犯罪具有相當高之慣性。

四、根據心理測驗及訪談結果，可將性侵害殺人犯罪人區分爲「中間型」、「有控制能力型」及「低控制能力型」等三種，其在「背景資料及人格特質」、「犯罪手法」、「犯罪現場特徵」亦均有其族群特性。

最後，本論文僅提供下列建議，供實務機關作爲硏訂防治性侵害殺人犯罪刑事政策制定參考：（1）建立性侵害殺人犯罪預警制度、（2）建構偏差心理及精神醫療體系、（3）宣導性侵害殺人犯罪之正確預防觀念、（4）加強偏遠地區安全防護工作、（5）建立性侵害殺人犯罪防制策略、（6）強化現場勘驗及科學鑑識、(7)性侵害殺人犯罪偵査建議事項、（8）建構電腦化犯罪連結資訊系統、（9）建立偵査、現場及心理剖繪三角偵査架構。

Abstract
In recent years in Taiwan, incidents of crimes have become a main stream in society. These crimes have become increasingly more violent and severe. Among those crimes, sexual homicide, which combines cruel characteristics of both sexual assault and homicide, causes a serious threat to the safety of vulnerable groups and women are the main victims of sexual homicide. This phenomenon has triggered a far -reaching after shock to the whole society.

In order to help people understand the characteristics of local sexual homicide cases and thus provide references to subsequent investigation and post research, the author has collected 42 sexual homicide cases occurring within last 10 years in Taiwan. The research has lead to a thesis in which nine suggestions are presented to deal with the far-reaching problems of sexual homicide.

The research method was based on qualitative and quantitative data. In-depth qualitative interviews and psychological tests were conducted on 12 sexual homicide convicts in order to explain the distinctive features of their mental status and behavior. In Quantitative method, content analysis was applied in order to analyze the information and thus come up with figures based on descriptive statistics and related analysis. The results summarized from this research are as follows:

A. The features of sexual homicide offenders, victims, scenario, modus operandi and crime scene are distinctive yet interrelated. Therefore, the crime prevention system can design strategies based on the above to
prevent crimes and avoid potential suspects and possible crime scenes. The investigators can also profile the figures of possible suspects according to the characteristics of crime scenes.

B. There are noticeable similarities and differences among sexual homicide, sexual assault, and homicide in terms of location, instrument, occupation and age of offenders, as well as characteristics of victims. Moreover, sexual homicide is more similar to homicide in terms of time, instrument
and characteristics of victims while it is more similar to sexual assault in terms of location, and characteristics of offenders.

C. In serial sexual homicide, it was noted after surveying three convicts that the average rate of similarity among cases committed by the same convict was as high as 78.57% rate. This means convicts have fairy high consistency when committing serial sexual homicide.

D. According to the outcome of psychological tests and interviews, this research has divided sexual homicide convicts into three types, “Self- control”, “Medium self-control”, and “Low self-control “. Each type has similar characteristics in “background information and personality”,
“Modus operandi" and “crime scene”.

At the end, nine suggestions provide references for the criminal justice system when making policies to prevent sexual homicide. They are:
(1) To establish alarm mechanism to prevent sexual homicide,
(2) To identify deviants and develop a mental-medical system,
(3) To educate in the prevention of sexual homicide and identification of possible offenders.
(4) To strengthen protection measures for remote districts,
(5) To propose preventive strategies for sexual homicide,
(6) To offer suggestions for sexual homicide crime investigation,
(7) To reinforce crime scene investigation and forensic identification,
(8) To build up a computerized information linkage system,
(9) To establish an investigative structure based on investigation, crime scene detection and criminal profiling.
