營造業由於其產業特性,在營建專案執行過程容易受各種因素影響致施工時
程遲延,無法如預定時程完成里程碑或完工。又,營建專案造價高、工期長,遲
延求償往往牽涉鉅大金額,所以營建專案遲延不但最常見也是金額最大的爭議。
因此,如何做好時程遲延後的責任分析與正確遲延日數評估,一直是營建管理者
所面對的主要挑戰。而共同遲延為營建專案遲延中最複雜與難處理之問題之一,
其也成為業主與承攬廠商間最易引發履約爭議的項目。鑑於共同遲延爭議結果涉
及損害賠償、成本補償及工期展延等重大權益,對雙方有著重大影響,且國內目
前尚無有效的共同遲延處理機制下,共同遲延分析的議題極需迫切去探討。
在工程界共同遲延的責任處理方法一般有四種,分別為誰先造成遲延法、支
配原因法、分配法及簡單法等四種。每一種方法均有其採用的理由,惟如何公平、
公正的分派共同遲延責任,則為本文之目的。共同遲延分析可分為兩部分,為工
程遲延分析及共同遲延責任分析。是,本研究從遲延各層面的影響分析起,然後
探討適合共同遲延情形之遲延分析方法,最後探討公平、合理的共同遲延責任分
配方法。因共同遲延發生情形迥異,故將其依組合及發生情形予以區,逐一探討
各共同遲延組合及發生情形之責任處理適用方法及其缺點。進而以遲延補救措施
趕工的觀點,以趕工成本作進一步分析,提出共同遲延責任分派之改進方法。對
於共同遲延責任分派,本研究的結論為,共同遲延的責任分配不應採單一原則,
而應比較各遲延契約效果、對專案停工性及趕工成本的影響,並以趕工成本的角
度作進一步分析,依共同遲延之組合及發生情形,按採取趕工或不趕工兩種情形
分派雙方責任,再依趕工評估之計算金額核算補賠償金額,如此才能更公平、合
理的分派共同遲延責任。
Because of the nature of the construction industry, the construction
projects are always unable to execute according to the planned milestone
or schedule for various kinds of causes. In recent years, as the
construction projects become larger and more complex, the volume of
dispute and litigation grew substantially and the amount claimed caused by
the delays also rapidly increase. Numerous causes can cause delay such
as adverse weather, strikes, contractor errors, change order, owner-directed
suspensions, third party, etc. Since the concurrent delay always involve
more than two delay causes, of which one is within the control of
contractor and the other beyond the control of contractor, and relatively
greater time as well as the amount of compensation. Among various
types of delays, concurrent delay is one of the most complicated and
difficult delays to manage and the disputes of concurrent delay already
become a major problem and there is no effective solution. Therefore,
how to fairly analyze the responsibility and accurately estimate the impact
of a concurrent delay is a main challenge. This study aims to fill this gap.
Previous studies have suggested four methods to allocate the
responsibility in a concurrent delay, First-in-line Approach, Dominant
Cause Approach, Apportionment Approach, and Easy Approach and each
approach has its adopted reason. However, none of them are widely
recognized and accepted. The purpose of this study is to establish a
model which can apportion concurrent delay responsibility fairly and justly.
This study consists of two parts: (1) analysis of delay time and (2) analysis

of delay responsibility. Many methods have been used to do the time
analysis of delay. This study firstly analyzes those methods and then
chooses an appropriate analytical method for concurrent delay based on the
cause and effect relationship and the consequences. Moreover, a model of
responsibility apportionment for concurrent delay is established under the
assumption that the delay can be remedied through work acceleration and
owner has the right to direct contractor to complete the project as originally
planned. In a delay situation, after the causes of the delay are identified
and the time delay incurred by each cause is calculated, the cost of
acceleration for making-up the delay of each cause can be estimated and
the responsibility of the delay can be apportioned according to the amount
of acceleration and the responsibility of the causes of delay. From the
remedy point of view, the proposed responsibility apportionment model
can clearly measure the responsibility of both the owner and contractor in a
concurrent delay situation so as to avoid the potential disputes in the course
of the construction.
