本論文的研究對象為Hans Kelsen(下稱凱爾生)的基本規範理論。研究重點在於從凱爾生的純粹法學的一般結構出發，探討基本規範在其純粹法學之中所扮演的角色。並從其晚期關於規範的一般理論的研究中，探討基本規範的概念在其理論中的發展與演變，以期能夠提供研究者對於凱爾生的基本規範理論一種概略的理解。
全文共分為十章。第一章首先說明凱爾生的純粹法學的基本概念，特別是所謂的「純粹性」的概念在凱爾生的法學研究方法上的定位與意義。其次討論一些與法律有關的制度或學科，主要集中在法律與道德以及法律與科學的比較分析之上。這兩組對比性的概念是研究凱爾生的理論時所必須特別注意的，因為其間的差異正是純粹法學的特點所在。簡單的說，純粹法學的純粹性彰顯在兩點之上，其一是法律與道德判斷不同，法律能夠成為科學研究的對象，而不像道德判斷一樣是相對的。其二是法律科學與以因果性為研究重心的經驗科學不同，法律是一門規範性的科學，因此法律的研究對象是法律規範，而非僅僅是某種人類行為而已。
第二章則轉向規範的定義。凱爾生在《規範的一般理論》中將規範界定為意志行動的意義。筆者即欲從此定義出發，藉助分析哲學與語言哲學的一些相關討論，來分析意志行動的意義的內涵，並試圖描繪出規範與人類行動之間的關連性。簡單的說，凱爾生將規範的定義界定為意志行動的意義，而與陳述作為思想行動的意義相對。不論是意志行動還是思想行動，要言之，都是人類的一種心理狀態。而一個實證的法律規範則必然的是人類的意志行動的產物，這是實證法學或法實證主義與自然法理論最大的不同之處。
第三章則轉向規範的一般理論與規範體系的探討。本章主要的內容在於整理介紹凱爾生在《規範的一般理論》一書中對於規範所做的各種層次的分析。其中涉及諸多分析哲學的議題。在這一章中筆者將會說明凱爾生有關規範與關於規範的陳述之區分，以及邏輯原則並不適用於規範之上的理論，這一點是凱爾生晚期規範理論的重點所在。簡單的說，規範與關於規範的陳述不同，前者是意志行動的產物，也是意志行動的意義所在；而後者則是一個陳述，一個思想行動的意義。而凱爾生認為邏輯原則，如矛盾律、推論律等，僅能適用在陳述之上，而不能適用於作為意志行動的規範本身。換言之，規範本身是沒有真假值可言的，只有關於規範的陳述才有真假值之分。這使得部份的學者認為晚期的凱爾生在思想上轉向了所謂的「非理性主義」。
第四章接續前兩章對於規範的討論，筆者計劃稍微花一些篇幅來說明規範理論與一些有關的哲學問題，特別是實然與應然之間的區分，筆者以為這是凱爾生全部規範理論的基礎所在。另外筆者也嘗試從康德的知識論著手，簡單的比較分析康德與凱爾生對於知識的性質的分析的異同之處，並檢討凱爾生對於其他學者的理論的觀點，特別是他對於應然與實然一元論的批判。
前面三章主要的目的在於為基本規範理論提供較為一般性、原理性的說明。而自第五章開始，將進入對於基本規範理論的介紹。凱爾生的基本規範理論是其法律理論的基礎，也是其理論的特色所在。在本章中，筆者將會說明基本規範的基本意義，基本規範的作用─作為法律體系的效力理據，以及基本規範的性質。學者之間對此的討論很多，而且爭論不休，筆者在本章中試圖較為清晰的去描繪凱爾生的基本思想框架。
第六章是動態原則的說明。凱爾生認為法律體系是一個動態體系，而與道德規範作為一靜態體系不同。動態體系中的權威是不確定，或是可以變動的，而動態體系的規範內容也是無法確定的，所有的規範內容都必須有賴於得到基本規範授權的權威來創設。因此，在一個動態體系之中，唯一的不變者就是基本規範，其效力並非來自於人類的意志行動，而係來自於人類的思想行動，因此其為一邏輯上的預設規範，而非如其他法律規範一般是實證規範。本章即在討論基本規範於動態體系中所發揮的作用，主要在於討論法體系的統一性、規範的效力與實效等問題。
第七章的主題是法律體系。在討論過基本規範與動態原則之後，我們最後再將焦點轉向其最終的產物─法律體系。本章筆者主要藉助Raz所做的分析，來探討在凱爾生的基本規範理論下，法律體系所呈現出來的面貌。主要討論的重點在法律體系的存在性、同一性的判準與效力之鏈等問題之上。
在簡要的說明完基本規範與法律體系的問題之後，在第八章中，筆者將要進行兩位重要的法理學家對於法律體系的基礎的理論比較，亦即凱爾生的基本規範理論與哈特的承認規則理論之間的比較。筆者在本章中想要以哈特的想法為出發點，先闡述哈特的主要理論結構，使讀者能夠複習一下哈特法理論的主要論證，再將之與凱爾生的理論作一比較，並說明兩人的理論中的衝突與共通之處。
在第九章中，筆者想要從幾個議題出發，重新省視凱爾生的學說，綜合前面各章所提出的說明與評論，將筆者所認知的基本規範理論的特點標示出來，試圖呈現出凱爾生的基本規範理論更為清晰的樣貌。當然，這章之中也包括了筆者對於凱爾生的理論的一些批評論證，希望能從不同的角度來詮釋凱爾生的基本規範理論。
最後一章是結論，在結論中筆者整理本文中主要的論點，並指出筆者在思考和論證上的不足之處，希望日後的研究者能夠加以批評與改進。
