國際航空法在國際法的領域中尚屬較新之分支學科,自一九四四年芝加哥公約簽署後以降,始具有完整之規範體系。其中關於航權之種類,則於芝加哥公約附件中之「國際航班過境協定」以及「國際航空運輸協定」中有所規範。前者包含了過境權及技降權,即第一及第二航權;後者則除了前述兩種航權外又規範了另外三種商業性航權,亦即第三至第五航權。關於之後發展出之第六、第七、第八乃至第九航權,並未於芝加哥公約中明文加以規定。本文欲探討之第六航權乃實務上結合第三及第四航權之操作而來,雖未規範於芝加哥公約中,但在航空公司以經營成本最小化,創造利益最大化之前提下,第六航權之操作已經躍升而為航空公司營利之最重要利器。在航空公司大量操作第六航權之結果下,對於第六航權法律體制之規範,亦因而愈顯重要。
本文首先將就第六航權發展之歷史做一概括性之介紹,繼而分析是何種誘因使得航空公司大量操作第六航權以及操作第六航權所應具有之條件。再探討各國國內法對第六航權限制的原因以及方式。而本文將以亞洲為例,整理分析亞洲各主要國際機場操作第六航權之概況來瞭解其對該航權使用之程度。進而聚焦我國所處之東亞及東南亞地區,探討各國發展軸輻式機場的概況、美國「自由化」雙邊協定之影響,以及各國際機場競爭之情形,進而提出解決之方法。對於兩岸四地發展第六航權的限制以及解決之道,亦將以專章之方式加以討論。本論文於最後的部份將做出總結以及針對台灣對於第六航權所應持有的態度,提出幾點建議。
International air law is a new branch in the field of international law. The legal system had not been constructed until the conclusion of the Chicago Convention1944. Two Annexes of the Chicago Convention 1944, “International Air Services Transit Agreement” and “International Air Transport Agreement”, stipulated the Five Freedoms traffic. The former includes Transit Right and Technical Right; the latter mainly comprises the other three commercial rights. The Sixth, Seventh, Eighth and Ninth Freedom traffic, which developed by state practice, were not mentioned in these two Annexes. The Sixth Freedom traffic, the topic of the thesis, although not be included in the Chicago Convention 1944, has been playing an important role to airlines in making profits. To construct a legal system will be a desideratum for the operation of the Sixth Freedom traffic due to the operation of it is getting more and more.
Firstly, we will give a recapitulative introduction to the history of the operation of the Sixth Freedom traffic, and then list the incentives and conditions for airlines to operate the Sixth Freedom traffic. In addition, we will discuss the restrictions which states placed in the operation of the Sixth Freedom traffic by their national law and the reasons for doing so. Moreover, we will take Asian international airports for examples to analyze the effect of incentives and conditions on the operation of the Sixth Freedom traffic. Furthermore, we will focus on East and Southeast Asian countries to discuss the consequence of the development of new hub-and-spoke international airports, the impact of the liberalized bilateral air transport agreement, and the competition among Asian airlines industries, and we are going to bring forward the resolution to it. Finally, we are going to deal with the barriers of the Sixth Freedom traffic operation amongst Taiwan, Hong Kong, Macau, and Mainland China.
In the last part of the thesis, we try to come up with some pieces of advice for Taiwan authority on the attitude to the operation of the Sixth Freedom traffic. It is important for Taiwan to operate the Sixth Freedom traffic, on account of that Taiwan is a small island, it’s flag carriers need passengers from other countries to support their operation.
