有關PSI部分，由於開發中國家或低度開發國家之關務制度未臻健全，該等國家為維護其財政利益乃與出口國境內民營公證檢驗公司簽訂委任契約，委由特定之公證公司於進口貨物裝船前事先為檢驗，以確認貨物內容是否與載貨證券上之記載相符。GATT部長級會議中考量開發中國家之實際需求，遂賦予其國際法源，制訂裝船（運）前檢驗協定予以保障，凡WTO會員國均負有遵守之義務。我國現為WTO會員國之一，自應遵循「使用會員國」之義務。而我國為對於進口國政府指定之公證公司加以監督管理，亦已訂定相關內國法規，以供參酌。至於進口國於出口國境內所指定之公證公司是否因而於特定市場形成「獨占」者，本文謹於第四章加以探討。

而就CSI而言，美國紐約市於西元二○○一年九月十一日遭受恐怖攻擊後，即開始檢驗其國土之安全，由於全球輸美之貨櫃量佔該國總運輸量之九成，而曾確實經檢驗者，竟未達百分之二，因此該國海關及邊境保護局即提出貨櫃安全檢查計劃，並將實施對象區分為輸美貨櫃量全球排名前二十名及以外之港口，逐漸推行實施。其後美國亦提出相關配套措施：二十四小時艙單作業規則及海關貿易夥伴反恐計劃。

全球各港倘若不願配合美國辦理加入CSI計劃者，美國將會對於該國之出口及轉口貨櫃進行更嚴格之貨櫃安全檢查。如此一來，將可能導致通關障礙，此將會降低出口國之貿易競爭力，實不容忽視。因此，我國對CSI之執行相當重視。

我國高雄港輸美貨櫃量經美國最初統計列為第四大港（西元二○○六年排名已退居第世界第六），是為輸美貨櫃量全球排名前二十大貨櫃進出港，而為配合美國CSI之執行，交通部高雄港務局及財政部高雄關稅局等相關單位於臺美雙邊未完成CSI聲明簽署前，即已陸續積極籌備當中。現今臺美雙邊已正式簽署CSI並進入執行階段，財政部高雄關稅局亦已依照相關作業規則運作。本文謹就所蒐集之資料，於經整理後再一一加以鋪陳，俾期使本文更具時代性。
