臺灣博碩士論文加值系統

契約文件之本質為對於契約所有行為之規定與舉證之資料。鑒於工程專案契約金額日趨於龐大，亦趨於複雜化等因素，致使工程契約條文與契約文件業已變的多樣化。
本研究乃針對國內外學者之論點，提出一明確之「契約文件之組成」架構；將工程契約之執行流程，依工程生命週期之概念，建立各契約流程所參考與規定之「契約文件」，並與「國內之法令規定」作鏈結；再以「文件探勘」之「資訊擷取過程」，建立契約文件之間的關聯性；並使用「概念圖」之網狀鏈結架構，建立工程契約文件間之關聯概念架構圖；最後，就契約文件間之關聯性、法律層面之契約成立論點與系爭工程之爭議起因態樣，探討「契約之重要關聯文件」、「契約成立之必要文件」與「工程爭議與契約事証文件」。
依據本研究結果，工程契約雙方關係人在執行契約管理與處理爭議時，兩造雙方即可依工程契約之執行程序、工程契約文件之引用與爭議之起因提出有效且有力之事證資料。

Contract documents are the certain evidence of contractual execution procedures. Nowadays, more and more engineering projects are getting enormous and complicated so that the terms of contract and contractual documents are becoming various.

This study aims at the arguments from local and foreign scholars. First of all, a clear structure of “composition of contractual documents” is proposed. Second, according to the concept of construction life cycle, we discuss the execution procedures of contractual actions’ references of contractual documents and linked with local regulations. In addition, we establish relevance between contract documents by the Information extraction of text mining. Then, the mesh links in concept map is utilized to build the connection of conceptual framework diagraphs. Finally, based on the interrelationship of contractual documents, formation of contract in law, and the causes of contractual disputes, then the significant and relevant contractual documents, the essential documents of contracts, and the evidence of construction dispute documents can be discussed.

According to the findings of this study, when both parties of a contract enforce contractual management and handling disputes, they can propose effective proofs based on the contractual execution procedures, the references of contractual documents, and the causes of contractual disputes.
