專利是企業的重要智慧財產權,企業使用專利侵權訴訟進行維護智慧財產權的利益,或騷擾競爭對手,已成為企業創新管理常見的議題。過去此類研究僅聚焦在發生專利訴訟事件前後的股價異常報酬變化,但並未針對事件的輕重程度進行探究,是否當索賠金額愈大時,專利訴訟的嚴重性亦愈形更盛?本研究使用事件研究法,驗証當專利侵權訴訟案件且要求首次索賠金額的訴訟雙方公司之股價異常報酬的變化;並進一步使用橫斷面迴歸分析,以首次索賠金額為自變數衡量其對市場價值變化的影響。結論如下:一、當專利侵權訴訟案件發生時,被告公司的股價異常報酬負向顯著下降;而原告公司的股價異常報酬雖正向上升,但未達顯著水準;二、當原告公司首次索賠金額愈大時,則被告公司的企業市場價值下降愈顯著;三、當被告的公司獲利力愈高時,愈能緩衝市場價值下降的幅度。
The continual application of patents and the use of patent infringements against competitors have become common practices in the protection of a firm’s intellectual property right.
Prior studies merely focused on patent infringements against firms’ abnormal return. Less attention attempted to clarify the relationship between the effect of severity of a patent infringement and the firm’s market value. This study uses the method of event study to examine the impact of patent lawsuit filing in an initial claim on the change of market value for both the defendant and plaintiff firms. Besides, we further tested the relative influence of an initial claim in terms of dollar amount on the defendant’s stock abnormal return through a cross-sectional regression. The empirical evidences indicate: (1)The defendants’ market value declined significantly when facing patent infringement lawsuits, but the plaintiff firms experienced no significant gains. (2)The larger the initial claims that the plaintiff filed, the more significantly the defendant’s market value declined. (3)A firm’s financial return helps buffer the decline of its market value.
