自美國911攻擊事件之後，世界各國紛紛研議運用生物特徵辨識資料於國境管理上，尤以歐盟、美國為主的西方國家，發現以民航飛機為標的恐怖攻擊事件層出不窮，於是各國不斷強化入出境旅客安檢的措施，近年來國際民航組織(ICAO)也推動國際打擊犯罪工作，強烈建議各會員國採用生物特徵辨識通關系統。我國雖並未加入該組織，但在行政院「民國 99 年度施政方針」中，明確指出我國支持國際打擊恐怖主義行動及推動多邊反恐合作之政策，並明示於100年採用個人生物特徵辨識系統進行通關檢驗，以保護國家安全。目前內政部入出國及移民署於100年3月29日舉行金門水頭商港自動查驗通關系統試營運，成為我國第一套實際上線使用的快速通關系統，正式宣告我國入出國查驗業務邁入電腦自動化的階段。
然而，生物特徵辨識資料運用於國境管理，仍存有爭議，蓋個人生物特徵資料蒐集及資料庫之建置雖屬於各國行政部門的公權力範圍，若無適當的保護機制，極易引起侵犯個人隱私的疑慮，尤其對資料庫的保管以及未來遭到連結使用所可能引發的問題，令人擔憂。本論文主軸主要是探討向來強調尊重人權重要性的歐盟，對生物特徵辨識資料的運用以及個人資料保護之間的關係。
論文共分六章，各章要旨為：第一章緒論：說明研究之動機、目的、方法、架構、範圍與限制；第二章生物特徵辨識與個人資料保護制度之探討：透過生物特徵辨識之概念、類型、運用，以及個人資料保護之概念、發展趨勢，延伸探討生物特徵辨識運用之個人資料保護現況及衍生之問題；第三章歐盟國境管理運用生物特徵辨識制度之探討：探究歐盟國境管理運用生物特徵辨識制度之沿革、制度架構與相關法令；第四章：歐盟國境管理運用生物特徵辨識之個人資料保護議題分析：分別就歐盟個人資料保護以及生物特徵辨識之個人資料保護層面來探討國境管理運用生物特徵辨識個人資料保護問題；第五章歐盟國境管理運用生物特徵辨識之實踐經驗：包括歐盟國境管理運用生物特徵辨識之執行情形、實踐成效、面臨之難題及啟示；第六章結論與建議：歸結各章研究結果後形成結論與建議，並提供政府未來國境管理運用生物特徵辨識及其對個人資料保護之參考。

Since September 11 attacks upon the United States, the world information on the use of biometrics in border management, especially in the European Union, the United States have dominated the Western world countries, the continuing civil aircraft found that the subject of an attempted terrorist attacks, so in addition to general entry and exit to strengthen passenger security measures, the recent International Civil Aviation Organization (ICAO) to promote the international fight against crime, urged Member States to adopt biometric clearance system. Although Taiwan did not join the organization, but in the Executive Yuan's "99 Republican administration policy," expressly stated that the country supports international efforts to combat terrorism and promote the policies of multilateral anti-terrorism cooperation, and expressed in 2011 by personal biometric recognition system for customs inspection, in order to protect national security.
However, the use of biometric identification information in the application of border management is still considerable controversy. The biological characteristics of the main database to collect and build, although subject to national public powers of the executive branch, it can easily cause an invasion of privacy concerns , especially for database storage, and use the next link may have been the problems caused by worrying. Therefore, the main motive of this study is the understanding of the importance of respect for human rights has always stressed the EU and other countries, the use of biometric data and the relationship between protections of personal data, are discussed.
This study is divided into six chapters, the thrust of each chapter are: Chapter I: interpreting motivation, purpose, method, structure, scope and limitations of the study. Chapter II: probing into biometric identification and personal data protection system of: biometric identification by the concept, type, use, and personal data protection concepts, trends, extension of biometric use of personal data protection status and derivative problems; third chapter the EU border management of the use of biometric identification system for the study. Chapter III: Exploring the EU border management, utilization The Evolution of biometric identification systems, system architecture and related laws; Chapter IV: analyzing EU border management, utilization of biometric identification of personal data protection issues: protection of personal data in respect of the EU and the biometric identification of the Personal Data Protection aspects for management of border the use of biometric personal data protection issues. Chapter V: EU border management, utilization of practical experience in biometric identification: the use of the EU border management, implementation of biometric identification, practical results, and Revelation is facing the problem. Chapter VI: in order to providing future use of biometric identification border management and protection of personal data reference, attributing to the formation of the chapter, the results of conclusions and recommendations.
