As the Internet gains popularity, the types of Internet crimes become diversified. In the past, discussions mainly surrounds the chapter of offenses against reputation slandering according to the traditional ways of communication, however, due to the development of new Internet media, the kinds of offenses against reputation slandering have gained new appearances. Such as the Bulletin Board Systems, which emphasized participation and real-time interactions. Emails, changed the old style of mailing. blogs, a new way of self-presentation, and the social networks to rebuild interpersonal relationships, such as, Facebook. This thesis is a discussion of the development of slandering and other crimes against reputation on the bases of Internet communication theory. To study the Internet communication’s distinctive characteristics, and then prove the theory through actual case studies, the thesis will attempt to introduce the sorts of Internet communication and discuss the possible ways to constitute offenses against reputation slandering via the Internet media. The thesis also collects and analyzes typical opinions on offenses against reputation slandering, both, before and after the Internet boom, to identify the controversial issues and the difficulty of application of the law. The main focus will not be limited to defining the concept of “publicity” and “the intentional distribution“, but discussion of referenceable historical opinions . Finally, this thesis will give a conclusion to the controversial issues, and make suggestions to lawmakers or those in practice, in order to find a reasonable and effective method for these kinds of problems.
