依據行政院勞工委員會2011年統計資料，截至100年9月底國內外勞總人數已突破40萬大關，合計417,844人，其中以從事社福之外籍勞工人數最多，達195,815人，約占全部外勞人數46.86%，而在社福勞工中又以外籍家庭看護工及家庭幫傭(本報告統稱為外籍家事勞工)二類總人數最多，合計達185,692人，占全部外勞人數之44.44%，占社福外勞人數之94.83%，顯示出國人對外籍家事勞工需求之殷切。
這群飄洋過海來到台灣的東南亞女性外籍家事勞工，她們以廉價的勞力，擔負起國人老、弱、殘、病的照護以及家務料理的繁重工作，形成一股安定台灣家庭、社會的重要力量，但政府的外勞政策卻未能妥適保障她們的基本勞動權益，回報她們的竟是排除勞基法的適用、不得自由轉換雇主、工作及攜眷的限制、雇主的監控，以及仲介的支配與剝削等等不公平的對待，成為台灣社會最底層，最受壓迫的一群勞工。本研究係本著關懷外籍家事勞工的立場，從政府的外勞政策、法令等面向，來探討外籍家事勞工在工作場域中所面臨的歧視與困境。
本研究首先從我國引進外籍家事勞工之背景與現況談起，接著論述我國現行外勞政策制訂者心中所蘊藏的排他性意識形態，進一步討論在「客工計畫」體制下所制訂的外勞政策，對低階的外籍家事勞工勞動權益之歧視情形，並與主要來自歐美地區所謂的白領外勞互相比較，藉以突顯我國「一國兩制」的外勞政策對低階外籍勞工的歧視狀況，同時列舉出在此種不公平的政策下外籍家事勞工引申面臨的主要困境。另為論證來台外籍家事勞工之勞動權益及尊嚴遭受歧視情形，本研究亦對外籍家事勞工、雇主、仲介公司以及地方政府主管機關等進行訪談，對一般民眾進行問卷調查。本研究亦對因工作具特殊性，被排除在勞基法適用範圍之外的外籍家事勞工，另訂「家事服務法」進行討論。最後在結論中就政策面如何解決外籍家事勞工在其勞動場域中所面臨的歧視與困境以保障其勞動權益，提出具體實用性的建議。

According to the statistics of the Council of Labor Affairs, Executive Yuan (2011), the number of foreign laborers in Taiwan has exceeded 400,000 by September 2011, totaling 417,844. Among them, the majority took up employment in the social welfare sector, reaching 195,815 in number, accounting for 46.86% of all foreign laborers. Of foreign laborers in the social welfare sector, the majority worked as home carers and domestic helpers (referred to as ‘foreign domestic laborers’ in this paper), totaling 185,692 in number, representing 44.44% of all foreign laborers. Such a high percentage is still on steady rise month by month. It indicated Taiwan’s urgent demand for foreign domestic laborers.

Flown in from Southeast Asia, these (mostly female) foreign domestic laborers offer their cheap labor and take charge of the care for the elderly, the frail or disabled, on top of the home chores, and by so doing, they constitute the pillar of security for Taiwanese families and society. However, the government’s foreign laborer policies haven’t yet to appropriately protect these laborers’ basic labor rights. In return to their contributions, they are exempted from the due application of Labor Standard Act, not allowed the freedom to change their employers, being imposed various restrictions on work and restricted from bringing their families to Taiwan, subject to the surveillance and control of their employers, being manipulated and exploited by agents, thereby reducing them to the society’s most-oppressed bottom class. Taking a humanitarian stance for the foreign domestic workers, this research explores -- from the aspects of foreign labor policies and legislations -- the discrimination and predicaments faced by foreign domestic laborers in their work environment.
First and foremost, the research started with a discussion of Taiwan’s background and the current state of foreign domestic laborers influx, followed by an exposition on the exclusionist ideology embedded in the mind of Taiwan’s foreign-laborer policymakers. Then, the paper proceeded to further expound on the foreign laborer policies formulated under the Guestworker Program and the ensuing discrimination resulted from such policies against the bottom-rung foreign domestic laborers. Comparison was also made against the policies concerning white-collar foreign laborers from Europe and the US. This subsequently amplified Taiwan’s discrimination against the bottom-class foreign workers under its foreign laborer policies characterized by ‘one state, two policies’. Meanwhile, all major predicaments faced by foreign domestic laborers under such unjust policies were outlined. As part of the arguments elucidating the discrimination and impingement against foreign domestic laborers’ work rights and dignity, the research included interviews conducted with foreign domestic laborers, employers, agents and local governmental departments concerned, while questionnaire survey with the general public was also done. The research also examined and discussed the Household Service Act especially set down for foreign domestic laborers who were exempted from the liability/protection of the Labor Standard Act due to the special nature of their work. Lastly, in conclusion, specific and practical suggestions in terms of governmental policies were proposed as solutions to improve the discriminatory and predicamental situation faced by foreign domestic laborers in their work environment so as to safeguard their labor rights.
