從清代禁止臺灣人民與蕃人結親，到近年每五對新婚夫妻中，就有一對是涉外婚姻。時代的變遷，社會結構的改變，內國人與外國人愈趨頻繁的往來，造就涉外事件日益增加。正如同內外國人之通婚，係自嚴禁走向開放，昔日固守的公序良俗、道德規範，在今日、明日世人的眼中，未必有相同的詮釋。
　　九○年代尚屬隱諱的同性議題，未來是否仍為禁忌，不得而知。未能否定的是，從古至今，不論是東方社會還是西方國家，不論是遠古時代或是高度文明的今日，同性戀始終存在。異性戀者，嘗試定義「同性戀」這個極不熟悉的名詞，在負面辭彙不斷堆砌、渲染的情況下，恐懼、排斥油然而生。而未能得到家人、社會認同之同性戀青少年，在遭受孤立、仇視、迫害後，有些人選擇以激烈手段了結此生，有些人直到成年選擇避走他鄉與伴侶共度一生。
　　二○○一年起，歐美國家之同性婚姻逐一合法化。我國對於同性婚姻雖未明文禁止，又因國家人權報告書，使得同性婚姻之議題再度引起關注，然而，短期內欲促使國內同性婚姻合法化，恐非易事，蓋因結婚之成立與否，將衍生各種法律效果，夫妻、親子等身分關係也將隨之發生變化，宜謹慎行之。是以，不啻是學者或是實務見解大多採取保守態度。在現行法未明文規定同性婚姻之效力，且他國實體法對我國法院無拘束力之情況下，是否意味我國可全然否定同性婚姻？本文特以國際私法之觀點，就我國公序良俗條款與美國婚姻保護法之比較，探討全盤否認涉外同性婚姻之良窳，進而檢驗現行制度下，承認涉外同性婚姻之可能性，期於比較各論點後，能在我國公共秩序、善良風俗與身分法保障之既得權間取得一平衡點，以作為選法之參考。

Abstract
People in Taiwan were not allowed to marry foreigners in Qing Dynasty while there have been one to fifth spouses from other countries in recent years (2001-2009). Times change, so does the social structure. The frequent contact with foreigners brings increasing legal disputes having foreign elements. As the prohibited marriages change into normality, rules and moralities people abided by in old days may stand for different meaning nowadays or afterwards.
Even though same-sex matters were still taboo in 1990’s, it might remain room for further public acceptance of these secretive issues in the future. What we are sure is no matter in ancient time or in present, in western countries or in eastern societies, homosexuals do exist. Heterosexuals attempt to define homosexual whom they are not familiar with, but fail. Negative descriptions of homosexual, one after the other, cause fear, rejection, and hostility. Thus, more and more misunderstood homosexuals are pressed to take suicide or go abroad to wed.
It is since 2001 that same-sex marriages have been legalized in European countries gradually. So far, there are also six states permitting same-sex marriage in the United States. When it comes to our country, there is no prohibition of same-sex marriage stated in our law. The concern of same-sex marriage is raised again recently, because of country reports on human right practices. However, marriage has many legal effects which affect relationships between family members, for instance, the right to inherit spouse’s property, the right for a couple to adopt a child together, and so on. It is not easy to legalize same-sex marriage in our country within such a short period, so most scholars and people working in practice take conservative attitude toward this matter. Nevertheless, as our courts are not constrained by other countries’ regulations, it is still a doubt that whether or not we can deny overseas same-sex marriage totally in the condition that there is no rule stating the effect of same-sex marriage.
The essay compares the public policy in our Private International Law with the Defense of Marriage Act (DOMA) in American Law, examining the pros and cons of denying foreign same-sex marriage, and discussing the possibility to recognize the overseas same-sex marriage in present legal system. The goal is to find out a balance between the public policy and the rights conferred by foreign same-sex marriage for the reference of choosing law.
