近年環保意識的崛起,使得綠色能源相關產品,例如:發光二極體(Light-Emitting Diode, LED)照明越來越受到重視。目前全球LED大廠利用智財手段來鞏固市場優勢,其中專利技術授權為其中的一個重要方式。全球LED大廠之間為了彼此市場競爭利益,彼此協議交互授權,使得全球LED專利佈局形成一個緊密的智財網絡聯盟。在高科技產業中,活躍的台灣廠商該如何進入全球LED產業授權網絡聯盟,為本研究所要探討的主題。本研究收集有關LED產業的歷史訴訟及授權資訊,研讀LED基本知識並建構出技術本體論。檢索國內外廠商之LED專利,並且利用資料採礦技術與關鍵詞彙擷取技術擷取出專利之關鍵字詞,搭配LED技術本體論進而產生出LED技術與關鍵字詞本體論。另外,本研究訂定出一套智財法則流程,首先根據各種不同之行為模式的結合會產生何種智財機會,建構出行為模式矩陣表,接著針對各種不同的智財機會擬定一連串的流程步驟,例如:專利分析、授權談判、專利侵權鑑定等,提供廠商在面對各種智財手段時處理方法之流程。因此,經過研究方法可以分析出公司之間之智財機會以及授權金或賠償金額的估算。透過本研究能夠較快速的分析自身技術且訂定進入全球LED市場之策略,使台灣廠商了解自身公司所擁有之專利優勢,以利進行專利授權談判或專利侵權訴訟時能夠提出的專利籌碼,以促進台灣廠商於LED產業的競爭力。

Due to the trend of increasing environmental awareness, green energy related products and industry are growing quickly. Light-Emitting Diode (LED), one of the products in the field of green energy, has gradually replaced the conventional bulb. This research studied the knowledge of LED and established the LED technology ontology. We can classify the patents of LED companies by using the LED technology ontology. The findings can provide the LED companies a better understanding for the technical scope of their own patents. Nowadays, the major LED companies use their intellectual properties to gain their competitiveness and protect their market advantage. The critical patents or patent portfolios, developed in house or licensed from other technology leaders, are commonly used to build the intellectual network for fending off competitors in the marketplace. Moreover, the global LED companies try to form alliances by using the patent cross-licensing. To be globally competitive, how to cooperate with the LED technology leaders is the main challenge of Taiwanese LED enterprises. This research focuses on the empirical analysis of past cases for LED technology followers were seeking cooperation with LED technology leaders. First, search the patents of the LED companies from USPTO online system, and classify these patents by using the ontology. We can see the technology coverage of patents of each company on the ontology. Next, the research created a set of rules of IP knowledge to show the process of IP conduct, so that the target Taiwanese LED companies can use the proposed rules to evaluate patents of their own invention and further to develop the strategies of suitable IP protections and licensing. Consequently, this research helps enterprises effectively analyze the technology scope of the patents and evaluate the opportunity of cooperation with other manufacturers.
