近幾年來隨著智慧型行動通訊裝置的急速發展,國際各家大廠紛紛大量投資搶食這塊大餅,使產業內的競爭程度也急遽上升,導致智慧型行動通信裝置業展開專利侵權大戰,而為爭奪智慧型手機市場這塊大餅,使各家廠商不惜投資重金,以驚人的溢價來購買遠超過市值的公司,其目的是為了被併購公司手中的關鍵專利。
在智慧型手機專利戰爭中,企業為避免侵權,專利交易頻繁,因為對於訴訟案件侵權的權利金,往往都會為企業來沉重的負擔,因此如何分辨出企業本身所擁有之技術,與產業內企業不同或相同之處,成為現今專利分析的熱門議題。
本研究根據專家建議及參考智慧型手機訴訟專利期刊The Smartphone Patent Wars (Lloyd, 2011),將以專利共被引分析(Patent Co-citation Analysis, PCA)方法加上訴訟的觀點來分析出智慧型手機專利主要可分為哪些技術領域,再選擇其中一個技術領域(無線傳輸)作更深入的探究,搭配陳樹榮與賴奎魁(2012)提出的自我技術網絡觀點去更進一步觀察廠商間專利知識聯繫關係,
研究結果顯示本研究之評估計算方法TKR&;TKS與CIK&;CEK可以解釋無線傳輸機制技術領域之廠商專利技術領先狀況,讓位於在這領域中的廠商,可以更清楚地了解自己與其他廠商的相對位子,經過數據的理性分析,可以降低企業作出錯決策的風險,能夠讓企業在將來防衛或是進攻策略,作出有利於企業持續生存的判斷。
In recent years, with the rapid development of smart mobile devices, international companies are investing heavily eat this pie so that intra-industry competition levels also rose sharply, causing the device industry intelligent action patent infringement battle Competition for smart phone market that piece of pie, so that all companies willing to invest heavily, with amazing premium to buy far exceeding the market value of the company, which is aimed at the merged company in the hands of the key patents.
Smartphone patent wars in the enterprise in order to avoid infringement, patent trade frequently, since cases violations of rights often come a heavy burden for the enterprise, how to distinguish themselves with technology, and industrial enterprises of different or the same, patent analysis on today''s hot topics.
