隨著經濟發展、教育與國民生活水準的提高，保險需求日益增加，國人可說已將保險商品做為個人日常生活保障及風險理財的必需品。但由於保險主要在規避消費者因不同風險而產生之需求，在保險商品及服務之型態日趨複雜，一旦業務人員因本身行為與保戶發生招攬爭議時，所造成之傷害無論在財力、人力、商譽均無法彌補。事出必有因，其因果關係下，去年（2013年）在金融消費評議中心保險輔助人非理賠申訴案件中業務員招攬爭議就佔了78.49%，再加上媒體過去負面之保險報導、經紀人公司及業務人員遭裁罰案件、主管機關頒修新法令規範、保險經紀人之專業責任險保額提高，都是因為業務人員或經紀人公司之招攬行為或管理不當，使保戶受有損失，因而面臨民、刑事之法律責任及行政處分，連帶經紀人公司需負賠償責任。因此本研究從業務人員招攬作業的五大流程：面晤保戶、商品解說、反對處理、簽約收費、遞送保單，藉由本國法院對於保險經紀人因招攬糾紛之判決，並採用失效模式與效應分析法（Failure Mode and Effects Analysis，FMEA）進行分析及說明，計算出風險指數RPN值作為防制作業風險管理依據。
研究結果發現，招攬作業風險的發生主要與經紀人公司內部的管理不善有密切關連性，而且這種管理不善在招攬作業的五大流程彼此之間也具有相互影響性。因此，為避免各種作業風險可能造成經紀人公司之損害及賠償，研究建議經紀人公司應優先處理招攬的「品質」管理，建置事前防制系統，以達到積極有效的防阻、防範未然與避免事件的重蹈覆轍，才能對公司、業務員以及保戶造成三贏層面，使經紀人公司能成為保險市場楷模，達到穩健經營目標。

With the progress of economic development, education and people’s living standards, the demand of insurance is rising. Insurance products can not only be personal daily life assurances but financial risk management necessities. Insurance, however, is to avoid from customers’ demands based on different kinds of risk. Due to the more complicated insurance products and service, once insurance agents have solicit issues with the insured because of self-behaviors, the damage of finance, human resources and reputation cannot be made up. Under the cause and the effect, last year (2013), Financial Ombudsman Institution shows that agents’ solicit issues accounted for 78.49% in Insurance Intermediaries’ non-claim complaint cases. The negative insurance reports from the mass media, the cases of laying off and penalty for brokers and agents, new laws and regulations of related authorities, and the increasing insurance coverage of brokers’ professional responsibility, are all because of agents’ and brokers’ solicit misbehavior and improper management, leading to the loss of the insured, the penalty of civil and criminal responsibility and the brokers’ joint and several liability. Therefore, based on the sentences of insurance brokers’ solicit issues, the study utilizes Failure Mode and Effects Analysis to analyze and explain the risk index RPN value as the prevention management of operation risk from the five major agents solicits processes: the meeting with the insured, products explanation, objection handling, contracts signing and charge collection, and insurance forms delivering.
The results describe that the major solicit issue risks are closely related to internal improper management of brokers’ companies and there are interplays between this improperness and the five major solicit processes. To avoid from various operation risks leading to the loss and claims of brokers’ companies, the study suggests the brokers’ companies should first deal with the solicit quality management and build prevention systems to reach effective risks avoidances. In this way, there will be three wining aspects among companies, agents and the insured, making brokers as a good example in the insurance market and accomplishing the goal of steady operation.
