保單貼現市場起源於1990年代的美國，其英文之「viatical」來自拉丁文，意義為「最終旅程的補給」。從原本癌症或重症病患藉由出售保單換取金錢以供醫藥或生活開銷之目的，迄今已成為金融市場中之一項投資工具。保單貼現與傳統證券或基金等金融商品不同，由於其所投資者乃被保險人之死亡時點，較不受市場景氣之波動影響，因此非常受到投資人所青睞，惟卻也因此產生許多爭議。
保單貼現風潮亦曾吹進台灣，然由於國內缺乏相關法令加以規範，且國外許多保單貼現公司均相繼遭到調查或倒閉，造成台灣投資人受有損害而求償無門，而後金管會亦禁止保險業務員招攬或推介未經許可之保單貼現商品，並發文金融機構禁止其販售保單貼現投資商品予一般投資人。
本文試以美、英、加、中等國進行比較法分析，探討保單貼現之性質與在我國之法律監管問題，並於文後提出本文見解，試提出保單貼現於我國適用之法律問題與監管模式。

Viatical Settlement market originated in the 1990s in the United States, the word, viatical, comes from the Latin, which means "the supplements of the final journey. ". The purpose of viatical settlement has changed from the financial supports of the people suffering severe illnesses or cancers to a new type of investment instruments in financial markets. The most difference between viatical settlement and other investment instruments is that viatical settlement focus on the timing of the death of the insureds, rather than the fluctuation of the market. As a result, it was very attractive to investors; however, some disputes also arose from time to time.
Viatical settlement had been popular for a period of time in Taiwan; nevertheless, due to the lack of regulation, and some offshore viatical settlement companies had been investigated by their local government or went out of business, causing the damages of investors in Taiwan, the Taiwan FSC discouraged the insurance agents and financial institutions from selling viatical settlements products.
This paper analyzed the legal issue in comparative aspect, including the USA, England, Canada and China, discussing the legal and supervision problems of viatical settlements in Taiwan, and tried to find a better way solving legal issues and supervision problems.
