近年來兒童虐待事件頻傳，依據衛生福利部保護服務司的統計資料，遭受兒童虐待的高風險族群為6歲以下學齡前兒童，施虐者主要是父母，而主要施虐的原因在於缺乏親職知識。
首先，本文探討兒童權利的演變，兒童權利公約明確宣示兒童是權利的主體，國家為保障兒童權利的義務主體，但因兒童欠缺完全行為能力來行使其權利，國家有責任以立法、行政各種措施，給予兒童特別保護政策。以兒童最佳利益為考量，家庭是最適合兒童生長的環境、父母是最適合擔任教養子女的人選，因此國家保障家庭完整性和父母親權；但發生兒童虐待事件時，基於「國家為親」的觀點，國家為保障受虐兒童之權利，對於父母濫用親權之權利或未盡親權之義務，國家可以介入兒童虐待事件而限制父母的親權。
我國目前兒童虐待防治的保護制度，多著重於發生兒童虐待之後的處置流程，以預防醫學之三段預防理論觀點來看，乃屬於次段和第參段預防措施。要達到預防勝於治療的效果，應針對兒童虐待的風險因子來落實初段預防措施，亦即對高風險發生兒童虐待的學齡前兒童之父母進行親職教育。
本文建議將第一線接觸嬰幼兒的醫療人員納入家庭教育專業人員範圍內，藉由我國完善的疫苗接種制度與兒童照護衛教制度，定期追蹤新生兒到學齡前兒童的生長發育，並反覆衛教指導父母與照顧者正確的親職知識，尤其是親子共讀的技巧，期能杜絕兒童虐待事件之發生。

Abstract

Child abuse incidents have been increased in recent years. According to the data of the Department of the Ministry of Health and Welfare, the high-risk victims of child abuse are pre-school children under the age of six years old. The main abusers are their parents. The main cause is that these abusers are lack of parenting knowledge.
First of all, this thesis explores the evolution of children's rights. The Convention on the Rights of the Child clearly declares that children are the holders of all the rights enshrined in the Convention. States parties are the subjects of obligation to protect children's rights. Because of the lack of ability for complete conduct of children to enjoy their full rights, Article 4 of the Convention obliges states parties to “undertake all appropriate legislative, administrative and other measures for the implementation of the rights recognized in the present Convention.” Meanwhile, the native family is the most suitable environment for the child to grow up, and parents are the most suitable candidates for parenting. Therefore, states parties shall guarantee family integrity and parental rights. However, when parents abuse their parental rights or don’t fulfill their parental obligations in the event of child abuse, states parties need to protect the rights of the abused child and can limit parental rights based on the concept of“parens patriae.”
At present, the protection system for the child abuse in Taiwan mainly focus on the treatment after child abuse incidence happens. From the view of the three-stage preventive medicine theory, these protective measures belong to the second and the third preventive stage. Since prevention is better than treatment, early prevention measures should be implemented in response to risk factors for child abuse. In other words, it is important to reinforce parental education for parents of pre-school children who are at high risk of child abuse.
This thesis proposes to include the first-line medical personnel, who are in contact with infants and young children, in the scope of family education professionals. By way of the vaccination system and child health education system in Taiwan, the growth and development from newborn to preschool children are regularly tracked. The medical personnel teach parents and caregivers about the correct parenting knowledge and the technique of parent-child shared-reading in order to prevent child abuse incidents.
