There are almost 545 thousands of marriage-based migrants in Taiwan. It takes up 2.3% of Taiwan’s population. There are more than 267 thousands of new immigrants who have suffrage which represent Taiwan’s new power group! However, plans can never keep up with changes, government hasn’t formulated suitable national population policies in response to the drastic change of demographic structure. Subordinated regulations can only be slightly adjusted which cause lots of legal problems when immigrants came here. Overseas and domestic interviews have been implemented for over 14 years. Due to indefinite legal concept, no matter the interview is approved or denied, there is still all sorts of criticism. Our overseas outposts and border management agencies are allowed to have free and not regulated judgement. This study is to understand how the regulations and systems were established. Besides interviewing immigration officers, the study will also discuss the regulations of the interview. If a foreign spouse applies for residence visa based on family support reason but got denied by our overseas outposts, the only current method is to file administrative appeal and administrative litigation. Due to that our people and their foreign spouses cannot fulfill the marital obligation to cohabitation, they should be able to file administrative litigation to protect theirs and their foreign spouses’ legal rights as well. This study will also discuss both the legal and practical practice.
