隨著全球產業的快速發展，產品規格標準化的需求也愈趨增加，「產業標準制定組織」（Standard Setting Organization，簡稱“SSO”）也因此大量地成立，或是又可以稱之為「產業標準開發組織」（Standard Development Organization，簡稱“SDO”），幾乎每個產業都有其相關的產業標準制定組織，高科技產業尤有甚者，特別是與我國產業息息相關之資訊與通信科技產業（Information and Communication Technology，簡稱“ICT”），不論是在哪個產業裡，這樣的標準制定組織皆有越來越重要的趨勢。

　　目前在全世界佔有舉足輕重的網路與行動通訊之科技也都必須仰賴ICT產業技術的進步，其背後的產業標準制定組織推動了相關之技術的標準化亦促進了整個產業的發展，而貢獻技術方案的企業亦稱得上居功厥偉，除了引領全球科技的潮流之外，更可以透過產業標準的制定，將企業所擁有的專利綁入技術標準而成為標準必要專利（Standard Essential Patents，簡稱“SEPs”）。

　　然而，這種結合專利權與技術標準而產生的標準必要專利，在近年來卻出現了許多的問題與爭議，如本論文研究之對象－美商高通公司就是利用標準必要專利的授權來進行操控市場之實，進而壟斷市場，造成許多的不公平競爭，因而引發全世界各國一系列的反壟斷調查。
本文試著從全球各國競爭法主管機關對美商高通公司之反壟斷或反不公平競爭調查之案件中所發現的事實，綜合其在標準必要專利授權方面的不當手法，以及比較研究各國競爭法主管機關在調查完成後，紛紛對高通公司所作出的高額罰款、行政處分或是提起訴訟之內容。

　　這些壟斷與不公平競爭的行為皆是透過標準必要專利之授權合約的締結所衍生出來的，這樣的合約關係不僅牽涉到締約當事人的權益，更影響到各國政府對於標準必要專利權人以產業標準規格訴請排除侵害、申請核發禁制令、或請求侵權損害賠償之權利行使行為，是否應受到一定的限制，其權利是否構成濫用、以及有否違反競爭法規範的問題一一浮現。

　　進一步地由這些在各國所產生的高通案來看，在標準必要專利授權事項方面應有的省思與借鏡，透過對於標準必要專利之授權事項與授權合約內容之條款成份的剖析，從而探究標準必要專利之授權的方方面面須注意什麼事項，以及提供相關的建議，包括就被授權企業之立場應注意事項、授權企業尋求被授權人應有的立場以及我國政府對於標準必要專利授權方面對於產業所應扮演的角色，期能幫助我國科技產業從業人員在進行標準必要專利授權之時，有可資參考的建議與做法。

With the rapid development of the global industry, the demand for product specification standardization is increasing, and a large number of Standard Setting Organization has been established. Each industry has related Standard Setting Organizations, especially in the high-tech industry, especially the industry of Information and Communication Technology (“ICT”) relevant to Taiwan’s economics.

At present, the technologies of the internet and mobile communication that are important in the world must also rely on the technological progress of the ICT industry. The Standard Setting Organizations (“SSOs”) or so-called the Standard Development Organization (“SDOs”) behind it promote the standardization and boost the development of the industry. No Matter which industry it is in, such standard setting organizations have an increasingly more and more important trend. Corporations that contribute technical programs are also regarded as creditable, not only leading global technology to the trend, but also through the process of standard setting, the patents can be tied into technical specifications to become the standard essential patents (“SEPs”).

However, this kind of SEPs created by combining patent rights and technical specifications have encountered many problems, controversies, and caused many issues in recent years. For example, the US-based Qualcomm Corporation (“Qualcomm”), uses the licensing of SEPs to monopolize the market, which has triggered a series investigation of anti-trust in various countries all over the world.

This article tries to synthesize its improper practices in granting SEPs from the facts found in the Qualcomm cases in countries after the completion of the investigation, and synthesize its improper methods in the licensing of SEPs, and compare the competition laws of various countries. After the completion of the investigation, the competent authorities have imposed high fines, administrative sanctions or filed lawsuits against Qualcomm.

These acts of monopoly and unfair competition are all derived from the conclusion of standard-essential patent licensing contracts. Such contractual relationships not only involve the rights and interests of the contracting parties, but also affect the government’s industrial standards for standard-essential patent holders. The question of whether the exercise of the right to rule out infringement, apply for an injunction, or request compensation for infringement damage should be subject to certain restrictions, whether the right constitutes an abuse, and whether there is a violation of the competition law norms.

From the perspective of these Qualcomm cases in various countries, there should be introspections and reflections on the licensing of SEPs. Through the analysis of the licensing matters of the SEPs and the clauses and components of the licensing agreement is explored. What matters should be paid attention to in all aspects of the licensing of essential patents, and provide relevant suggestions, including the matters to be noted on the position of the licensee company, the position of the licensee company can seek from the licensor, and the Taiwanese government’s attitude to the industry in terms of SEP License. The role it should play is to help employees in Taiwan’s high-tech industry to have referable suggestions and practical ways that can be referred to when facing SEPs licensing.
