767號解釋是2019年大法官所作出的重要解釋之一，其內容主要是針對藥害救濟制度進行進一步的解釋與說明。這號解釋在行政訴訟確定近5年才做成合憲解釋，大法官更提出十份意見書，包含4份不同意見以及1份部分不同意見，可見大法官之間對於本號解釋的內容有著不小的分歧。
本文透過767號解釋，來回顧藥害救濟制度的發展，並討論大法官所提到的重要法律概念。首先，需要回顧藥害救濟制度在台灣的發展與法規的制定，並提出幾個重要的案例，以及767號解釋之前的訴訟。接著，本文接續討論幾個與本號解釋相關的重點，包含法律明確性原則、生存權、健康權以及違憲審查比例原則，配合學者的見解，來思考767號解釋對於上述概念所帶來的影響，並於最後提出本文的反思。

The Judicial Interpretation No. 767 is very important in 2019. It is all about drug relief and to explain how it works. This Judicial Interpretation could be explained after nearly five years administrative litigation. And the Justices proposed ten opinions, included four dissenting opinions and one dissent in part. We can see the Justices are very divergence in this Judicial Interpretation.
This paper will through The Judicial Interpretation No. 767, to review the development of drug relief and some important concepts. First, we need to review he development of drug relief in Taiwan and how the drug relief law made, also put out some important cases. Next, this paper will discuss some important concepts, includes principle of clarity and definiteness of law, the right to survive, the right to health and proportionality of Constitutional review, and cooperate scholars opinions, to think what influence brought by Judicial Interpretation No. 767. At last, this paper will prevent some reflections.
