本文共有六章。依序為序論、文獻探討、研究方法、日本防制人口販運機制的現況困境
與對策、台灣防制人口販運機制的哲理現況與困境、結論與建議。文末添附參考文獻與附
錄。第一章序論，敬分三節以討論本文研究背景、動機、目的及名詞解釋；名詞解釋的部
分，主要是解釋聯合國、台灣以及日本對於「人口販運」之定義。第二章文獻探討，同前三
分；第一節探討聯合國防制人口販運機制相關文獻，包括《聯合國打擊跨國有組織犯罪公
約》以及其與防制人口販運相關之議定書、行動計畫及政治宣言。第二節探討相關國際組織
防制人口販運機制相關文獻，包括一、國際刑警組織：〈關於新冠肺炎對移民偷渡及人口販
運之衝擊〉。二、歐盟警察組織：〈在2019 聯合大規模行動中發現的476 位潛在人口販運被
害者〉。三、歐盟邊境管理署：〈歐盟邊境管理署及國際移民組織共同打擊歐盟地區及
MENA 地區的兒童販運及走私問題之網路研討會〉。四、歐洲安全與合作組織：〈歐洲安全
與合作組織和合作夥伴共同組織的專家圓桌會議得出結論：以器官切除為目的之人口販運需
要國際社會的緊急關注〉。五、東協警察組織：〈東協公告2019〉。六、巴厘進程：〈經由海
路的移民偷渡與人口販運〉。七、國際移民組織：〈國際移民組織、聯合國毒品與犯罪問題辦
公室加強合作，以打擊人口走私並解決亞太區域非常規移民〉。第三節則引用國際及國內外
學者之文獻來介紹日本防制人口販運之機制。第三章為研究方法，敘述本文研究流程、採用
文獻探討法與比較研究法、並遵守研究倫理。第四章分為三節，各別探討日本防制人口販運
機制之現況、困境與對策。包含美國人口販運報告對日本的評價、日本官方每年召開相關防
制會議作成報告、以及日本民間團體指出因應修法而生的新興人口販運JFC 被害類型。第五
章同樣三分，探討防制人口販運之佛教哲學思想、台灣防制人口販運機制之現況與困境。第
六章為結論與建議，第一節對本文內容加以總結，第二節則綜論本研究所得，提出可供改進
之建議。

There are six chapters in this article,which are the preface; literature discussion; research
methods; the current situation, dilemmas and counter-measures on Japanese human trafficking
prevention policies; the current situation, dilemmas and counter-measures on Taiwan’s human
trafficking prevention policies; conclusions and recommendations. References and appendices are
attached at the end of the article.
The first chapter is the preface, which is divided into three sections to discuss the research
background, motivation, purpose and noun explanation of this article; the part of the term
explanation mainly explains the definition of "human trafficking" by the United Nations, Taiwan
and Japan. The second chapter discusses the literature. The first section discusses the relevant
literature of the United Nations’ human trafficking prevention mechanism, including: United
Nations Convention against Transnational Organized Crime;The Protocol to Prevent, Suppress and
Punish Trafficking in Persons, especially Women and Children; The Protocol against the Smuggling
of Migrants by Land, Sea and Air; UN.GIFT; UN Global Plan of Action to Combat Trafficking in
Persons; Political Declaration on the Implementation of the United Nations Global Plan of Action to
Combat Trafficking in Persons. The second section discusses the relevant literature on the
prevention and control mechanism of human trafficking in relevant international organizations,
includes: Interpol, Europol, Frontex, OSCE, Aseanapol, The Bali Process, and IOM. The third
section quotes the literature of international and domestic scholars to introduce Japan's human
trafficking prevention mechanism. Chapter 3 is talking about the research method. The fourth
chapter is divided into three sections, individually discussing the current situation, dilemmas and
countermeasures of Japan's human trafficking prevention mechanism. The fifth chapter is divided
into three sections, discussing the Buddhist philosophy of preventing human trafficking, the current
situation and predicament of Taiwan’s mechanism for preventing human trafficking. The sixth
chapter is about the conclusions and suggestions. The first section summarizes the content of this
article, and the second section summarizes the findings of this research and proposes suggestions
for improvement.
