The purpose of this research is to explore the situation of spot checks and traffic stops by Kinmen County Police Bureau. The researchers have been working as police for many years and have deeply felt the pressure and frustration of the police on duty. They are often forced to fall into the gray area in order to strive for performance. Law enforcement officers do not know the dilemma of breaking the law. Therefore, in addition to understanding the connotation of the legalization of police prosecutions in our country, we also want to explore the blind spots and deficiencies in the law enforcement of Kinmen County Police Bureau, so that the police have a clearer understanding of the rule of law regarding the initiation of the powers of prosecution. Proper law enforcement seeks a balance between the protection of human rights and the maintenance of public order. In order to achieve the above research purposes, this research mainly uses the "interview method" to conduct research, interviewing with the police officers who work the Kinmen County Police Bureau. Five police officers were sampled, and the interview content was sorted and analyzed. The interviews are supplemented by related literature for research and comparison reviewed from the legal and practical aspects, so as to achieve the ideal of maintaining public security and protecting human rights. The conclusions obtained in this study are summarized as follows: The police, working in Jincheng Precinct and Jinhu Precint of Kinmen County Police Bureau, select the location and time of spot check and traffic stop mainly based on public security and traffic hotspots, as well as the business hours of the premises, and display it on the duty list which will be approved by the director of the Precinct. The police of the Jincheng Precinct and Jinhu Precinct of Kinmen County Police Bureau check passerby and vehicles by targeting people with weird behaviors and expressions, or those who violate traffic regulations because the purpose of spot check is to detect illegal or crime pursued. They are all implemented in accordance with relevant laws and regulations, and judged based on empirical rules. Police in Jincheng Precinct and Jinhu Precinct of the Kinmen County Police Bureau first identify the people’s identity. Police are all in uniforms when on duty, and they do not need to show their credentials or inform the cause if the person under investigation has no requirements. If a crime is suspected, the driver will be forced to leave the car, and the mobile computer will be used to verify the identity, including the license plate, driving license, vehicle license, or identity card. The officers of Jincheng Precinct and Jinhu Precinct of Kinmen County Police Bureau shall provide a record of dissatisfaction to the party when performing the spot check or traffic stop. If the party does not request it, the law enforcement officer will not issue it.
