Physical restraint was first used in psychiatry, but it was gradually extended to elderly care institutions, nursing homes, intensive care units, etc. The purpose of restraint is to maintain patient safety and prevent patients from being injured or hurting others. In acute medical care institutions, physical restraint is a nursing measure that is often used and necessary for medical assistance. In Taiwan, because of the education of nursing staff, nursing manpower or quality, the environment of medical institutions, etc., it will drive nursing staff to believe in the body constraints can reduce the occurrence of accidents and avoid legal liability, and unwilling to try to lift the constraints, which will cause greater damage to patients. In the implementation of restraint, there may be cases where the patient is injured when the restraint is signed but not executed immediately, or the patient is injured without promptly binding the restraint. In terms of medical administration, to avoid overtime work or overwork; the hospital’s equipment environment must take the patient’s safety as the main consideration, and in terms of constraints, equipment such as monitors may be added to truly monitor the patient’s occurrence of injury results without loose constraints. and many more. In combination with practical opinions, we can understand that the scope of criminal duty of attention may come from medical orders, medical routines, and medical contracts. On the other hand, in the judgments organized by the practical opinions, we also learned that in addition to the doctor’s orders, the binding behavior also has the judgment of a professional nurse, and this judgment is also based on the premise of medical routines. Therefore, this article believes that even if there is case of a "constraint contract", nursing staff can also make judgments on whether to loosen their ties according to medical routines, so as not to allow patients to be restrained for too long and produce sequelae caused by more constraints.
