本文建構了一個動態的全球健康治理架構,並強調全球層面和國家層面的互動關係。在全球的層面上,世界衛生組織及其所制定的全球健康規範,在實踐過程中面臨諸多障礙。其中最大的問題在於,世界衛生組織是由主權國家所共同組成的。因此在任何政策的制訂上,這些國家都先以本身的國家利益為優先考慮。其次,這些全球健康規範對國家行為的約束力,亦受到相當的限制。由於世界衛生組織的領導權威無法確立,因此也造成許多其他國際組織的挑戰,造成其權威的分散與腐蝕。這種在全球和國家層面的互動,不但弱化了以世界衛生組織為首的全球健康治理,同時一些重要國家在基於本身國家利益的考慮下,亦無意願擔負起領導全球健康體系的重責大任,因此,一個具有全球共識且具有相當成效的全球健康治理與規範,事實上並不存在。在國家的層面上,南北國家之間的觀念與政策上的差異,再加上北方主要援助國以外交取向的衛生外交,以及缺乏集體的長久合作,都成為建構有效全球健康治理和規範的障礙。
通過這兩個動態互動層面的探討與分析,我們發現儘管全球健康規範和全球健康外交,都是試圖從不同層面來追求建立人類更好的健康世界,但從一個全球規範性的觀點來看,兩者之間的互動在某種程度上,卻是呈現出一種相互矛盾和制約的關係。全球健康規範試圖去約束與引導國家的行為,但全球健康外交去是以國家主權和利益為主要依據,並進而形成對全球健康規範權威的一種挑戰,此正符合了建構主義所提出的動態互動框架。
This Thesis constructs a dynamic global health governance framework and emphasizes the interaction between the global and national levels. At the global level, the World Health Organization and its global health norms face many obstacles in practice. The biggest problem is that the World Health Organization is made up of sovereign states. Therefore, in the formulation of any policy, these countries give priority to their own national interests. Second, the binding force of these global health norms on state behavior is also quite limited. Since the leading authority of the World Health Organization cannot be established, many other international organizations have also been challenged, resulting in the dispersion and corrosion of its authority. This interaction at the global and national levels not only weakens the global health governance led by the World Health Organization, but also some important countries have no willingness to assume the responsibility of leading the global health system based on their own national interests, in fact, a global consensus and effective global health governance and norms do not exist. At the national level, differences in perceptions and policies between North and South countries, coupled with the diplomatically oriented health diplomacy of the North''s major donor countries, and the lack of long-term collective cooperation, have become obstacles to the construction of effective global health governance and norms.
Through the discussion and analysis of these two dynamic interaction levels, we find that although global health norms and global health diplomacy both try to build a better healthy world for human beings from different levels, from a global normative point of view. To some extent, the interaction between the two presents a contradictory and restrictive relationship. Global health norms try to constrain and guide the behavior of countries, but global health diplomacy is mainly based on national sovereignty and interests, and then makes a challenge to the authority of global health norms, which is in line with the dynamic interaction framework proposed by Constructivism.
