國際海事組職於海事保險領域發展上,從最原先的船員保險、船體保險至貨物保險的討論與規範上,都已有世界公認的制度為之,於近十幾年來,人員的保險理賠處理範疇上已擴張至海事相關產業,進而逐步重視海事勞工的權益與保障,遂於2013年開始生效施行海事勞工公約。
在海事勞工保險中,船廠的海事勞工投保內容種類最為繁雜,又較其他海事勞工職場出險事件較易發生,且於發生出險事件時容易衍生爭議,而使船廠的海事勞工權益常因保險競合因素而被擱置延宕或理賠額度不如預期。為此,本研究蒐集近五年船廠海事理賠情況,以及涵蓋各作業區與主要不同出險類別之22筆海事勞工出險案例,進行分析,以求了解保險標的廠內各作業區之承保風險情況與相關承保衡量要項與細項內容。
透過案例比較分析法與實地訪談法之質化分析工具,可以了解灰關聯分析(Grey Relational Analysis, GRA)、逼近理想解排序法(Technique for Order Preference by Similarity to an Ideal Solution, TOPSIS)之數量模組評估事項是否適合,同時也避免違背保險方的實務審理衡量情形。經過GRA分析後,得知投保方應更加重視此「艤裝廠」與「船體廠」兩作業區容易發生的出險事件成因、出險人次與傷殘程度、出險理賠申請總額度;其次,經過TOPSIS分析後,發現「出險事件勞工廠區年資」、「出險事件勞工年齡」的重要投保細項,甚為攸關海事勞工個體的防護力與理賠額度。
最後,本文所創設之複合型「船廠綜合大保險保單」可協助船廠、承攬商能夠了解該優先著重衡量調整來年續約複合型海事勞工公約 (Maritime Labour Convention, MLC)保單的重點要項,並於日後投保續約時,可以依此分析結果進行滾動式調整保單內容獲保險理賠條件,以使海事勞工權益獲得更佳的保障與照護。

The International Maritime Organization (IMO) in the field of marine insurance development, from the original crew insurance, hull insurance, to cargo insurance discussions and regulations, has been recognized as a system for the world. In recent decades, the scope of insurance claims handling personnel has been expanded to the maritime-related industries, and then gradually pay attention to the rights and interests of the maritime workers and their protection, so the implementation of the Maritime Labour Convention came into force in 2013.
Among the marine workers' compensation insurance policies, shipyards have the most complicated types of marine workers' compensation insurance policies, which are more likely to occur than other marine workers' compensation insurance policies and are prone to disputes arising from the occurrence of the insurance policies, which often result in shipyards' marine workers' compensation being put on hold due to insurance competition or the amount of claims being less than expected. To this end, this study collects marine claims from shipyards in the past five years and analyzes 22 marine labor insurance cases covering various operating areas and different types of risks in order to understand the underwriting risks of each operating area of the subject plant as well as the relevant underwriting measurements and details.
Through the qualitative analysis tools of comparative case analysis and on-site interviews, it is possible to understand the suitability of the GRA and TOPSIS quantitative modules, and at the same time, to avoid the violation of the insurer's practical audit measurements. After the GRA analysis, it was found that the insured should pay more attention to the causes of the risk events, the number of risks, the degree of disability, and the total amount of claims in the two operation areas of the "assembly plant" and the "hull plant"; secondly, after the TOPSIS analysis, it was found that the "years of experience of the workers in the factory in the event of a risk event" and the "age of the workers in the event of a risk event" were the important insurance details that were very important to the protection and the amount of the claims of the marine laborers.
Finally, the composite Shipyard Comprehensive Insurance Policy created in this article can help shipyards and contractors understand the priority of adjusting the key elements of the composite 2006 MLC policy for the next year's renewal and to make rolling adjustments to the content of the policy and the terms of the claims based on the results of the analysis when renewing the policy in the future, so as to provide better protection for the rights of maritime workers.
