臺灣博碩士論文加值系統

網際網路緣自20世紀90年代起開始被商業使用，迄今已有30年左右的時間，隨之而來的是各式各樣層出不窮的交易糾紛。本研究將會介紹各大不同國際組織對於當前跨境交易糾紛仲裁的指導原則處理辦法，分析以聯合國、歐盟以及東南亞三大跨境電商主要市場面對上述議題的發展歷程與處理辦法。同時將介紹線上跨境電商線上糾紛所可以主張訴訟外的交易糾紛雙方權利之通路，包括了訴訟外紛爭解決機制（Alternative Dispute Resolution，ADR）與線上糾紛解決與仲裁機制(Online Dispute Resolution),並通過回顧探討其發展歷程以及當前所面臨的問題。
本研究將先行介紹跨境電商之興起與當前產業環境，就線上糾紛事宜各大平台之處理辦法加以對比分析，同時介紹民眾仲裁（crowdsourced arbitration）之現況。整理上述之內容，結合我國當前之現況，最終對於我國在處理涉及到跨境電商線上糾紛所應完善的替代性爭端解決機制制度是否適宜進行總結論述，以供未來之參考。

Internet have been used commercially since the 1990s, and it has been about 30 years, followed by various transaction disputes. This study will introduce the guiding principles and handling methods of various international organizations for the arbitration of current cross-border transaction disputes, and analyze the development history and handling methods of the above-mentioned issues in the three major cross-border e-commerce markets of the United Nations, the European Union, and Southeast Asia. At the same time, it will introduce the channels for online cross-border e-commerce online disputes to claim the rights of both parties in transaction disputes outside of litigation, including Alternative Dispute Resolution (ADR) and Online Dispute Resolution (ODR), and discuss its development history and current problems through retrospect.
This study will first introduce the rise of cross-border e-commerce and the current industrial environment, compare and analyze the handling methods of various platforms for online disputes, and introduce the current situation of crowdsourced arbitration. After sorting out the above content, combined with the current situation in our country, we finally make a summary statement on whether the alternative dispute resolution mechanism system that our country should improve in dealing with online disputes involving cross-border e-commerce is suitable for future reference.
