本研究以台灣最大的研究機構-工業技術研究院(工研院)為例,探討其在專利運用和保險服務創新方面的策略價值與實踐途徑。透過文獻分析、個案研究、深度訪談和紮根理論,研究發現工研院正積極探索專利組合最佳化、授權模式創新和專利保險服務設計等策略,以期為產業界提供全方位的專利風險管理解決方案。受訪者普遍認為,類似專利池概念的專利保險服務,有望幫助企業更有效地預防和應對專利訴訟風險,同時降低研發和訴訟成本,但推廣過程仍面臨諸多挑戰。隨著專利競爭加劇,工研院正由注重專利數量轉向注重專利品質,聚焦關鍵技術領域進行策略性佈局,並整合內外部創新資源,以提升專利組合的綜合競爭力。
研究結果顯示,創新的專利營運模式,尤其是專利保險,不僅能有效幫助企業應對專利風險,還能活化專利資源、促進產學合作,是研發機構轉型升級、服務產業發展的重要策略。工研院應進一步完善專利服務定價和組合機制,加強與政府和產業界的溝通協調,優化相關制度環境。透過系統性分析工研院專利運用的實踐圖像,本研究提出專利保險等創新模式的策略價值,期能為研發機構乃至整個產業界的專利管理實務提供重要啟發。隨著工研院專利運用能力的持續提升,其在驅動產業創新發展、營造良性專利生態系統方面,必將發揮越來越重要的引領作用。
This study examines the Industrial Technology Research Institute (ITRI), Taiwan's largest research institution, to analyze its strategic value and practical approaches in patent utilization and innovation in insurance services. Using methods such as literature review, case studies, in-depth interviews, and grounded theory, the research reveals that ITRI is actively pursuing strategies like optimizing patent portfolios, innovating licensing models, and designing patent insurance services. These efforts aim to provide comprehensive patent risk management solutions for the industry. Interviewees generally believe that patent insurance services, similar to patent pools, could help companies more effectively prevent and address patent litigation risks while reducing R&D and litigation costs. However, there are many challenges in promoting these services. As competition over patents intensifies, ITRI is shifting its focus from the quantity to the quality of patents, strategically positioning itself in key technological areas, and integrating internal and external innovation resources to enhance the overall competitiveness of its patent portfolio.
The findings indicate that innovative patent operation models, particularly patent insurance, can effectively help companies manage patent risks, revitalize patent resources, and foster industry-academia collaboration. This is a crucial strategy for R&D institutions to transform and upgrade, supporting industrial development. ITRI should further refine its patent service pricing and portfolio mechanisms, strengthen communication and coordination with the government and industry, and optimize the relevant institutional environment. By systematically analyzing ITRI's practical experience in patent utilization, this study highlights the strategic value of innovative models such as patent insurance, offering significant insights for patent management practices in R&D institutions and the industry as a whole. As ITRI's capabilities in patent utilization continue to improve, it is expected to play an increasingly pivotal role in driving industrial innovation, fostering a healthy patent ecosystem.
