近年來高科技產業不斷上演專利戰爭,愈來愈多企業以專利侵權的法律手段解決商業競爭問題,根據美國專利局統計,近十年核准專利被用於侵權訴訟,每年成長達三十%以上,專利經常被用於衡量企業創新動能,也可用來衡量企業未來發展潛力和競爭力,因此許多研究用專利指標來衡量企業研發績效和檢視企業研發策略,專利分析是最常被用來監測目前最新技術發展趨勢,高科技廠商希望經由專利分析,確實反映產業的技術現況與趨勢,維持企業競爭優勢。

本研究以專利分析探討美國半導體產業之經營績效,研究期間為1999年至2011年,並以106家美國半導體公司為研究對象,結合美國專利商標局資料庫(United States Patent and Trademark Office, USPTO)和COMPUSTAT資料庫的相關資訊,並以人工類神經網絡的方法進行分析,探討專利集中度、專利引證數、發明人數對公司績效的影響。研究結果發現,專利集中度、專利引證數、發明人數與對公司績效具有正面的影響,美國半導體公司如果要提升其公司績效,應深耕核心能力,多培育關鍵專利發明人,產生高品質專利。


In recent years, high-tech patent wars continue to unfold, more and more companies to patent infringement legal means to resolve commercial competition. According to the U.S. Patent Office statistics, in recent years been used approved patent infringement litigation, up to thirty percent annual growth ; patent is often used to measure the kinetic energy of innovative enterprises, can also be used to measure the company's future growth potential and competitiveness, thus many studies using patent indicators to measure performance and view corporate R & D strategy, patent analysis is the most commonly used to monitor the latest technology trends, tech companies hope through patent analysis, accurately reflect the status of technology and industry trends, maintaining corporate competitive advantage.
This study applies patent analysis to explore U.S. semiconductor industry 's operating performance during the study period of 1999 to 2011, and 106 U.S. semiconductor companies for the study, combined with the U.S. Patent and Trademark Office database (United States Patent and Trademark Office, USPTO) and COMPUSTAT database information, and artificial neural network analysis methods to explore concentrations of patents, the number of patent citations, the number of inventors impact on corporate performance. The results showed that HHI, the number of patent citations, the number of inventors have positive impacts on performance, the U.S. semiconductor company want to enhance its corporate performance should be cultivating core competencies and foster critical inventors to produce high-quality patents.
