臺灣博碩士論文加值系統

終止妊娠，又名人工流產、墮胎，這項行為中婦女生育的權利與義務的爭論，至今仍無定論。過去的歷史經驗中，中央政府並沒有掌控婦女的生育行為，墮胎術更與避孕術為常見的節育方法，如柏拉圖的《理想國》中曾提出，以墮胎來限制人口數量的問題，且《漢摩拉比法典》、《西哥特法》等古代法律中提及墮胎罪則，僅將墮胎視為傷害罪的加重類型。然而，民族國家現代化發展的過程中，各國認同「人力代表著國力」的概念，使得墮胎行為逐漸是一種違反國家的罪行。第一次世界大戰後，面臨德國境內的人力問題、墮胎問題時，一方面在中央政府除了延用《德意志帝國刑法典》中的概念並加上《威瑪憲法》中的指導原則，提出福利政策等獎勵措施與懲罰的規範；另一方面，民間中醫學界、婦女團體、教會團體、優生學等對於婦女墮胎問題也提出許多不同的意見。最後從本文研究中發現，即使在希特勒上台前，中央政府仍視「墮胎」為非法行為，但婦女們面對政府的法規、福利措施，與現實生活中的生活條件所產生的衝突中，發展出新女姓的形象，諸如職業新女性的形象、女性知識份子、家庭主婦的新面貌等。

“Termination pregnancy” is also meant abortion. In this behavior, abortion, there are arguments which the right and the voluntary of woman’s reproduction. There arguments still don’t have the conclusion until now. As a matter of fact, in the past, the Central authorities have not controlled woman's reproduction, and the techniques of abortion and contraception technique are the common methods of birth-control. For example, in Plato’s opinion, Plato agreed that abortion is one of good method to limit population quantity in Republic. Even if the abortion crime in the ancient times law, such as the Code of Hammurabi, the Visigothic Code, abort only regarded as the aggravation type of the assault. However, in the modernization process of nation-state, various countries approve the concept that high fertility was seen as a sign of national virility and military power, and the behavior of abortion was regarded as one kind of guilt. After World War Ⅰ,each group of people had different idea when they faced with German demographic problem and abortion question. On the one hand, Central authorities performed the notion of abortion law which is already in German Empire Penal Code and the principle of Weimar Constitution, and they also proposed welfare facilities. On the other hand, the folk groups of the medical groups, the women groups, the Christian religions, the eugenics had many different opinions. Finally, from this analyze that before Hitler’s times, the Central authorities still regarded as the abortion which is illegal. Nevertheless, the women had appeared new image in the conflict with government's expect and real life in living condition, such as new professional woman, women doctor, new housewife's look.
