二次世界大戰結束後，由於戰爭遺留問題仍困擾亞洲國家對日本的不信任和疑慮，甚至影響著日本與其他亞洲國家的合作關係。目前日本政府的道歉仍舊不足，再加上倖存者逐漸凋零，戰爭倖存者要求日本還給他們正義，也使得解決這個問題變得刻不容緩。日本和相關國家應該如何處理二戰遺留問題的方式都足以影響東亞區域關係的發展以及影響後代如何認識歷史的真相。
目前戰爭遺留問題，日本政府在法律訴訟方面居於有利位置，但此議題若僅是法律問題，是無法至今仍糾結著日本或其他亞洲國家，尤其是中國和南韓。因此它除是法律問題外，也涉及道德和政治。因此本論文希望能試圖從道德和政治面向分析此一議題。
本論文研究對象以中國和日本為主，主要應用Nick Smith的道歉理論於中日戰爭遺留問題。藉由這兩個國家瞭解戰爭遺留問題之所以無法輕易解決的困境以及透過Nick Smith的規範性道歉理論檢視日本政府過去進行過的道歉，並提供此戰爭遺留問題解決方向，方能消弭因其它國家對日本的疑慮，進而能與亞洲國家進行更緊密的區域合作。
從研究分析結果來看，儘管日本政府已多次公開就二戰罪行向受害者或受害國道歉，但日本政府截至目前所做的道歉仍有不足之處和尚有努力空間。日本政府應該彌補過去道歉的不足，公布相關歷史文件並由雙方所認可的第三方重新調查事實，承認和釐清發動侵略戰爭的個人責任，以及立法制定補償辦法與立法通過日本政府的道歉。
然而解決問題，並不能僅單靠日本政府的努力，中國政府亦有需要妥協與退讓之處，中國政府應減少利用此一議題作為外 交手段煽動中國民族主義達成其政治目的。

After World War II ended without the resolution of certain problems, Japan still is not trusted by other Asian countries. The problems affect co-operative relations. The Japanese government’s apologies are considered to still not be enough. Old age is claiming survivors of the war before their demands for justice are being satisfied making it all the more urgent to resolve this situation. What Japan and and other involved nations do will affect regional relations in Asia and how future generations view truth and history.

Legally Japan occupies a strong position. If this were only a legal issue, Japan and other Asian nations, particularly China and South Korea couldn''t become involved. However it is not solely a legal matter: it is also a moral and political matter. I intend to analyse this issue from a moral and political aspect.
This thesis will use Japan and China as examples and apply Nick Smith''s theory to their still-unresolved issues from the end of World War II. We can hopefully better understand why China and Japan cannot resolve their issues in this way. This thesis can also examine Japan''s apologies according to Smith''s theory, and formulate a possibly acceptable solution.

In conclusion, though Japan has publicly apologized to its war victims, the apologies have not been seen as being sufficient and Japan should be doing more to compensate these victims. However it is not a one-sided situation. China''s government has a part in helping to achieve resolution.
