The privilege to refuse testimony is the product of the balance of interests, in addition to avoiding the conflict between the witness's self-incriminating and the obligation to testify, but also for the community to recognize the various interests of the protection network. Therefore, the existence of the privilege to refuse testimony can be said to be in order to realize the legal principle of self-incriminating, as well as the purpose of safeguarding certain important interests in society, and choose the sacrifice for the real pursuit. In our country, according to the Criminal Procedure Law, the reason why the witness has to refuse the testimony is generally divided into the following categories: First, the privilege of refusal to testify due to self-incriminating; second, the privilege of refusal to testify due to kinship; third, the privilege of refusal to testify because of official relations; and the privilege to refuse testimony due to business relations.
