The government procurement nowadays is an important administrative measure for the state to handle daily public affairs, and has a deep relationship with the public construction, the development of the livelihood policy, and even the completion and soundness of the economic system. This article hopes to evaluate the feasibility of adopting the EU's competitive dialogue into Taiwan's Government Procurement Act through the author's practical experience and what he saw in the Taipei City Government's procurement of public office. Compared with the traditional law papers, the appendix of this paper interviews three public officials who are currently handling government procurement affairs. They come from purchasing unit, and business unit which execute procurement cases. By interviewing their views on the current Government Procurement Act, they then introduced the EU Competitive Dialogue system and then asked them to express their thoughts about the feasibility of adoption to the Government Procurement Act. In addition to the important basis and perceptions of this article, this appendix also looks forward to future reference when it comes to legislation. The Competitive Dialogue is firstly saw in the government procurement Directive NO.18 in the European Union's European Parliament in 2004. It is a measure that through dialogue or negotiation, to adjustment administrative agencies and private manufacturers on procurement targets to enhance the overall government procurement efficiency. This article is based on the principles, concepts and contents of the EU Competitive Dialogue. We reference the views of scholars and the appendix interview records to consolidate the gaps and inadequacies of the current Government Procurement Act. After we confirm the necessity of adopting the Competitive Dialogue to the Government Procurement Act in the dialogue system; then have an issue about the position of the Competitive Dialogue in Taiwan's Government Procurement Act, and finally discuss about the possible difficulties of the adoption. To sum up, in order to improve the above-mentioned problems in Taiwan's current Government Procurement Act, it is quite worthwhile to give a consideration of adopting the Competitive Dialogue to the Government Procurement Act. Since there seems no problems that is unable to solve from all aspects, and the authority of Government Procurement agency- the Public Construction Commission is keep promoting the innovative government procurement policy from 2016. In the market nowadays, intangible creativity, strategy and other capabilities are becoming more and more important, and the demand is also gradually expanding. There is on day that the government have to design a suitable procurement system for such intangible procurement. On this perception, we look forward our government can planning the system timely, understanding the pulsation of market, keeping the communication with people, improving the outmoded laws, there can achieve the goal of promoting the Innovative Procurement as soon as possible.
