臺灣博碩士論文加值系統

國際勞工組織（International Labour Organization, ILO）於2006年通過一項有船員權利法案（bill of rights）美譽之海事勞工公約（Maritime Labour Convention, MLC），其目的係為改善與保障船員的工作條件，淘汰次標準船（substandard ships）。該公約採「無差別待遇」（No more favorable treatment）之原則，強制要求航行於國際線且總噸位500以上之船舶，須符合公約規定，持有公約所要求之證書。公約生效後，符合公約規定之航行船舶須取得相關證明，以確保該船舶確實符合公約規定。船員是海上航行的核心人員，其勞動條件與福利應受重視。海事勞工公約將船員福利與上船工作資格標準化，以培育出適任的船員，並有效維護船舶航行安全。本研究將就海事勞工公約與我國船員相關法規作一比較，探討兩者之差異。同時針對勞、資及政府三方進行深度訪談，以瞭解該公約對三方之影響及其所採之因應措施。最後，歸納之結論與建議，將提供有關機關參考。

The International Labour Organization adopted the Maritime Labour Convention （MLC）in 2006. The Convention is also famed for a bill of rights with regard to seafarers. The purpose of the Convention is to improve and ensure seafarers’ working conditions in order to eliminate the substandard ships. The Convention adopted the principle of “No more favorable treatment”. It stipulated compulsively that vessels over 500 gross tonnages engaged in international route must hold a Certificate and Declaration that the MLC requires. After the Convention coming in force, the ships shall obtain the Declaration from the shipping company and the Certificate issued by an authorized organization respectively to ensure the vessel conforming to the Convention. Seafarers are key operators sailing on the sea; therefore, their working conditions and welfare should be emphasized. The Convention standardizes the welfare and working qualification in order to foster a qualified seafarer. In addition, the Convention shall protect the safety of life at sea. This study compared the Convention with the national laws of Taiwan related to the seafarers’ welfare and their differences shall be analyzed. This study shall explore the effect of Convention to the parties such as seafarers, shipping companies and the government. Meantime, the measures to the Convention shall be discussed. Finally, the conclusion and suggestion shall be summarized to be a reference for relative parties.
